Abstract

Iepriekšēji saņemtā pievienojuma institūts mantojuma tiesībās kalpo mantinieku mantiskā līdzsvara nodrošināšanai, taču tā piemērošana praksē rada būtiskus jautājumus par piemērošanas robežām, izņēmumiem un mantojuma atstājēja gribas lomu. Tēmas aktualitāti būtiski pastiprina 2024. gada 21. martā pieņemtie Civillikuma grozījumi, kas stājās spēkā 2025. gada 1. janvārī. Bakalaura darba mērķis ir analizēt iepriekšēji saņemtā pievienojuma institūta būtību un piemērošanu Latvijas mantojuma tiesību sistēmā, salīdzinot to ar Vācijas un Šveices mantojumu tiesību regulējumu. Darba rezultātā piedāvāts: grozīt CL 764. pantu; papildināt CL 763. panta pirmo daļu un 757. pantu; kā arī precizēt CL 760. panta otro daļu un CL 729. panta 1. punktu, lai veicinātu vienveidīgu un taisnīgu normu piemērošanu.

The institution of collation in inheritance law serves to ensure financial equality among heirs, yet its application in practice raises significant questions regarding its scope, exceptions, and the role of the testator’s intent. The relevance of the topic has been substantially reinforced by the amendments to the Civil Law adopted on 21 March 2024, which entered into force on 1 January 2025. The aim of the bachelor's thesis is to analyse the substance and application of the institution of collation within the Latvian inheritance law system and to compare it with the legal frameworks of Germany and Switzerland. As a result of the research, the following proposals are put forward: to amend Section 764 of the Civil Law; to supplement Section 763(1), and Section 757; and to clarify Section 760(2) and Section 729(1), with the goal of promoting uniform and fair application of the relevant provisions.
