Izlīguma administratīvajā procesā juridiskās problēmas

Abstract

Bakalaura darba mērķis ir izpētīt izlīguma institūtu administratīvajā procesā, aplūkot izlīguma vietu publisko tiesību sistēmā, analizēt izlīguma juridisko dabu, tā piemērošanas nosacījumus un ar to saistītās juridiskās problēmas. Bakalaura darba ietvaros tika identificētas problēmas, kas ir saistītas ar izlīguma slēgšanas praksi, kā arī aplūkota izlīgumam alternatīvā institūta, tas ir mediācijas, pielietojuma potenciāls Latvijā. Bakalaura darba ietvaros tika identificētas problēmas, kas ir saistītas ar izlīguma slēgšanas praksi, kā arī sniegti priekšlikumi izlīguma administratīvajā procesā institūta attīstībai Latvijā. Bakalaura darba ietvaros veiktā analīze balstās uz Latvijas normatīvajiem aktiem, tiesu praksi un salīdzinošo piemērošanu citās valstīs.

The aim of the bachelor’s thes is to examine institution of settlements in adminsitrative proceeding, to explore its place within the system of public law, and to analyse the legal nature of settlement, the condions for its applicaion, and the legal issues associated with it. During the analyse of the thesis were identified problems related to the practice of concluding settlements and were considered potential application of the alternative dispute resolution method as mediation in Latvia. Within the framework of the bachelor’s thesis, were identified problems related to practice of concluding settlements, and were made proposals for the development of settlement institute in administrative proceeding in Latvia. The analysis that were made out in the bachelor’s thesis are based on Latvian legislation, judicial practice, and comperative applicarion in other countries.
