Ar faktisko valdījumu pieņemta mantojuma problemātika

Abstract

Bakalaura darba mērķis ir analizēt mantojuma pieņemšanas ar faktisko valdījumu tiesisko regulējumu Latvijas mantojuma tiesību sistēmā un izvērtēt ar to praksē pausto problemātiku, kā arī rast iespējamos risinājumus problēmjautājumu atrisināšanai. Darbā tiek pētīta un analizēta tiesu prakse, lai izprastu mantojuma pieņemšanas ar faktisko valdījumu tiesību normu piemērošanu un interpretāciju. Autore darbā salīdzina Latvijas normatīvos tiesību aktos ietverto mantojuma pieņemšanas regulējumu ar ārvalstīm, Lietuvu, Igauniju, Vāciju, lai noskaidrotu to normatīvo regulējumu un tiesu praksi par darba tematu. Tiek pētīti problēmjautājumi, ar kuriem mantinieki var saskarties, pieņemot mantojumu ar faktisko valdījumu, un piedāvāti to risinājumi.

The aim of the Bachelor’s thesis is to analyze the legal regulation of inheritance acceptance through actual possession within the Latvian inheritance law system and to assess the practical issues that arise in this context, as well as to propose possible solutions for resolving these issues. The thesis explores and analyzes court practice in order to understand the application and interpretation of legal norms related to inheritance acceptance through actual possession. In the work, the author compares the regulation of inheritance acceptance contained in Latvian regulatory legal acts with foreign countries, Lithuania, Estonia, and Germany, in order to clarify foreign regulatory legal acts and court practice on the topic of the work. The research focuses on the problems heirs may face when accepting inheritance through actual possession and offfers solutions to these problems.
