Kriminālatbildība par tabakas izstrādājumu nelikumīgu izgatavošanu, uzglabāšanu, pārvietošanu un realizāciju

Abstract

Bakalaura darba temats ir “Kriminālatbildība par tabakas izstrādājumu nelikumīgu izgatavošanu, uzglabāšanu, pārvietošanu un realizāciju”. Bakalaura darba mērķis ir izpētīt un noskaidrot, Latvijas normatīvo aktu regulējumu tabakas izstrādājumu nelikumīgai izgatavošanai, uzglabāšanai, pārvietošanai un realizācijai, salīdzināt to ar ārvalstu tiesību avotiem, kā arī izanalizēt Krimināllikumā ietverto regulējumu, un salīdzināt tabakas izstrādājumu un elektronisko smēķējamo ierīču regulējumu, un to nepieciešamību pēc ietveršanas krimināllikumā. Lai sasniegtu darba mērķi, darba autore izvirzīja šādus uzdevumus: izpētīt Krimināllikuma 221.pantu attiecībā uz tabakas izstrādājumu nelikumīgu izgatavošanu, uzglabāšanu, pārvietošanu un realizāciju; izpētīt Latvijas Republikas regulējumu attiecībā uz tabakas izstrādājumiem; izpētīt un analizēt regulējumu elektroniskajām smēķēšanas ierīcēm un izpētīt ārvalstu regulējumu; Autore darbā saskatīja problemātiku kriminālatbildībai par tabakas izstrādājumu noziedzīgām darbībām salīdzinājumā ar elektronisko smēķēšanas ierīcēm.

The topic of my bachelor thesis is “Criminal liability for illegal manufacture, storage, movement and sale of tobacco products”. The aim of the bachelor's thesis is to study and clarify the regulation of the laws and regulations of Latvia for the illegal manufacture, storage, movement and sale of tobacco products, to compare it with foreign sources of law, as well as to analyse the regulation included in the Criminal Law, and to compare the regulation of tobacco products and electronic smoking devices, and their necessity for inclusion in the criminal law. In order to achieve the goal of the work, the author of the work set the following tasks: to study Section 221 of the Criminal Law in relation to the illegal manufacture, storage, movement and sale of tobacco products; to study the regulation of the Republic of Latvia in relation to tobacco products; to study and analyse the regulation of electronic smoking devices and to study foreign regulation; The author saw in the work the problem of criminal liability for criminal activities of tobacco products compared to electronic smoking devices.
