Transportlīdzekļu konfiskācija un tās aizstāšanana noziedzīgos nodarījumos pret satiksmes drošību

Abstract

Bakalaura darbā analizēta transportlīdzekļu konfiskācijas un tās aizstāšanas institūta attīstība Latvijas tiesību sistēmā, īpašu uzmanību pievēršot Krimināllikuma 70.13 un 70.14 pantu regulējumam. Šis regulējums tika ieviests salīdzinoši nesen, tāpēc praksē rada neskaidrības un atšķirīgu pieeju tā piemērošanā. Darbā tiek izvērtēta gan Latvijas prakse, gan atsevišķu valstu prakse šajā jautājumā. Izpētes rezultātā tiek identificētas problēmas transportlīdzekļa vērtības noteikšanā un piedāvāti risinājumi efektīvākai normu piemērošanai, tostarp priekšlikums ieviest speciālista piesaisti transportlīdzekļu vērtības noteikšanai noziedzīgos nodarījumos pret satiksmes drošību.

The bachelor’s thesis analyses the development of the institution of vehicle confiscation and its replacement in the Latvian legal system, with particular focus on the regulation set out in Sections 70.13 and 70.14 of the Criminal Law. This regulation was introduced relatively recently and, therefore, creates uncertainties and differing approaches in its application in practice. The thesis examines both Latvian practice and the practice of selected foreign countries on this issue. As a result of the research, problems in determining the value of a vehicle are identified, and solutions are proposed for the more effective application of the relevant legal provisions, including a proposal to introduce the involvement of an expert in determining vehicle value in criminal offences against traffic safety.
