Aizgādības tiesību atņemšana

Abstract

Ik gadu lielam skaitam vecāku Latvijā tiek atņemtas aizgādības tiesības, kas liecina par bakalaura darba temata īpašu aktualitāti. Autore, pētot aizgādības institūtu, aizgādības tiesību atņemšanas pamatus un procesu, secināja, ka normatīvajos aktos būtu veicami grozījumi, kas veicinātu izpratni par bērna psihiskās un emocionālās veselības nozīmību, bērna drošību interneta vidē, vairāk aizsargātu bērnu tiesības, kā arī sekmētu procesa tiesā efektivitāti un ātrāku lietas izskatīšanu. Tāpat tika secināts, ka praksē visbiežāk aizgādības tiesības tiek atņemtas saistībā ar to, ka vecāki nenodrošina bērna aprūpi un uzraudzību, citi aizgādības tiesību atņemšanas pamati ir sastopami retāk.

Every year, a large number of parents in Latvia are deprived of custody rights, which indicates the relevance of the topic of the bachelor's thesis. The author, having examined the institution of custody, the grounds for the deprivation of custody rights and the process, concluded that amendments should be made to the relevant legislation to promote understanding of the importance of children's mental and emotional health, enhance children’s online safety, better protect children’s rights, as well as improve the efficiency of the court proceedings and ensure faster consideration of the cases. It was also concluded that in practice, custody rights are most often deprived due to the fact that parents do not provide care and supervision of the child, other grounds for deprivation of custody rights are less common.
