Abstract
Bakalaura darba tēma ir uztura līguma personiskais raksturs. Uztura līgums kā civiltiesisks darījums Latvijas tiesību sistēmā ir atzīts un bieži noslēgts gados vecāku cilvēku aprūpei un uzturēšanai, pretī saņemot par to kādu noteiktu mantisku vērtību. Uztura līguma tiesiskā daba atšķiras no citiem civiltiesiskiem darījumiem, tādēļ darbā galvenokārt tiek analizēts uztura līguma personiskais raksturs, tā atspoguļojums Latvijas tiesību sistēmā. Uztura līguma personiskais raksturs Latvijas tiesību sistēmā ir samērā maz izpētīta tēma, tādēļ darba mērķis ir izprast vai Latvijas tiesiskajā regulējumā uztura līguma personiskais raksturs atspoguļo tā patieso izpausmi. Līdz ar to tiek pētīta un analizēta uztura līguma personiskā rakstura izpausme Latvijas tiesību aktos, tiesu praksē. Tiek salīdzināts Latvijas regulējums ar Lietuvas, Igaunijas, Vācijas, Šveices un Gruzijas tiesisko regulējumu, kas noteic uztura līguma noteikumus. The topic of the Bachelor’s Thesis is the personal nature of the maintenance contract. As a type of civil law transaction, the maintenance contract is recognized in the Latvian legal system and is commonly concluded for the care and support of elderly individuals, in exchange for certain material benefits. The legal nature of the maintenance contract differs from other civil law transactions. Therefore, the main focus of this Bachelor’s Thesis is the analysis of its personal nature, its reflection in Latvian legal system. The personal nature of the maintenance contract is a relatively underexplored topic in the Latvian legal system. Therefore, the objective of the Thesis is to determine whether the personal nature of a maintenance contract is accurately reflected in the Latvian legal framework. This Thesis examines and analyzes how the personal nature of such contract is expressed in Latvian legislation and case law. Additionally, the Latvian regulation is compared with the legal frameworks of Lithuania, Estonia, Germany, Switzerland, and Georgia, where maintenance contract provisions are also regulated.
