Naida noziegumi

Abstract

Pēdējo gadu desmitu laikā, pieaugot cilvēku dažādībai, var novērot naida noziegumu skaita palielināšanos. Naida noziegumu apkarošanai ir jāpievērš īpaša uzmanība, jo naida noziegumi kaitē gan cietušajai personai, gan tās kopienai, gan arī šķeļ sabiedrību, kas var novest pie citām kaitīgām sekām. Neskatoties uz to, ka starptautiskajā telpā naida noziegumu kaitīgumu akcentē jau salīdzinoši ilgu laiku, Latvijā pastāv problēmas ar naida noziegumu identificēšanu un apkarošanu. Autore bakalaura darbā “Naida noziegumi” analizēs naida nozieguma jēdzienu, pētīs nacionālo un starptautisko tiesisko regulējumu, tiesu praksi, norobežos Krimināllikuma 78. un 150.pantā paredzēto noziedzīgo nodarījumu sastāvus, kā arī iezīmēs problēmas un neatbilstības starptautiskajiem standartiem nacionālajā krimināltiesiskajā regulējumā un izteiks priekšlikumus to risināšanai.

In recent decades, the growing diversity of society has been accompanied by an increase in hate crimes. Special attention must be paid to combating hate crimes, as they harm not only the victim but also the victim’s community, and they fragment society, which may lead to further harmful consequences. Despite the fact that the detrimental nature of hate crimes has been emphasized in the international context for a relatively long time, Latvia continues to face challenges in identifying and combating such crimes. In bachelor's thesis "Hate Crimes," the author will analyse the concept of hate crime, examine both national and international legal frameworks and case law, distinguish between the constituent elements of criminal offences under Article 78 and 150 of the Criminal Law, and highlight existing problems and inconsistencies in national criminal regulation in light of international standards. The author will also offer proposals for improving the current situation.
