Abstract

Bakalaura darba tēma “Tiesas pieejamība kā tiesības uz taisnīgu tiesu elements civilprocesā”. Darba mērķis ir izvērtēt tiesas pieejamību kā tiesību uz taisnīgu tiesu elementu civilprocesā, analizējot pieejamības nozīmi Latvijas tiesību sistēmā, normatīvajā regulējumā un tiesu praksē, kā arī identificēt problēmjautājumus un sniegt priekšlikumus efektīvākas pieejas nodrošināšanai. Lai sasniegtu šo mērķi, sākotnēji tika aplūkots tiesību uz taisnīgu tiesu jēdziens un, kā pieeja tiesai ietilpst šajā principā. Tālāk pievērsta uzmanība jurisdikcijas nozīmei civiltiesisko strīdu izskatīšanā un tās ietekme uz taisnīgas tiesas nodrošinājumu. Trešajā nodaļā autore pievēršas saziņas ar tiesu iespējām un pašaizstāvības tiesību nozīmei. Darbā ir secināts, ka efektīva piekļuve tiesai ir neatņemama taisnīgas tiesvedības sastāvdaļa un autore ierosina veikt normatīvā regulējuma pilnveidošanu, lai nodrošinātu šo tiesību ērtu un pilnvērtīgu īstenošanu. The topic of the bachelor thesis is “Access to Justice as an Element of the Right to a Fair Trial in Civil Proceedings”. The aim of the thesis is to assess the accessibility of the court as an element of the right to a fair trial in civil proceedings, analysing the importance of accessibility in the Latvian legal system, regulatory framework and court practice, as well as to identify problematic issues and provide proposals for ensuring a more effective approach. In order to achieve this objective, the concept of the right to a fair trial and how access to justice fits into this principle were initially examined. It then turns to the role of jurisdiction in civil disputes and its implications for ensuring a fair trial. In the third chapter, the author focuses on the possibilities of communication with the courts and the importance of the right of self-representation. The work concludes that effective access to justice is an integral part of a fair trial and proposes improvements to the legal framework to ensure the convenient and full exercise of this right.
