Pienākumi veselības datu apstrādē: MI akta un VDAR mijiedarbība

Abstract

MI strauja attīstība ir radījusi būtisku ietekmi veselības aprūpes jomā, savukārt MI akta pieņemšana ir radījusi vairākus jautājumus attiecībā uz personas datu, it īpaši veselības datu, apstrādi. Bakalaura darba "Pienākumi veselības datu apstrādē: MI akta un VDAR mijiedarbība" mērķis ir noskaidrot vai un kādas atšķirības pastāv starp MI akta un VDAR prasībām konkrēti veselības datu apstrādes kontekstā. Pētījumā tiek analizēta veselības aprūpes iestāžu loma MI akta izpratnē, tiek apskatīta MI aktā noteiktā sistēmu riska klasifikācija, kā arī analizēta MI sistēmu, ko izmanto veselības aprūpes nozarē, vieta šajā iedalījumā. Bakalaura darbā tiek identificēti četri aspekti, kuros MI akta un VDAR regulējums mijiedarbojas.

The rapid development of artificial intelligence has had a significant impact on the field of healthcare, while the adoption of the AI Act has raised several questions concerning the processing of personal data, especially health data. The aim of the bachelor’s thesis “Obligations in the Processing of Health Data: The Interaction Between the AI Act and the GDPR” is to determine whether, and what kind of, differences exist between the requirements set by the AI Act and the General Data Protection Regulation specifically in the context of health data processing. The research analyses the role of healthcare institutions within the meaning of the AI Act, examines the risk classification of AI systems as defined in the AI Act, and assesses the position of AI systems used in the healthcare sector within this classification. The thesis identifies four key aspects in which the legal frameworks of the AI Act and the GDPR interact.
