Viendzimuma attiecību tiesiskais regulējums: problēmas un perspektīvas

Abstract

Viendzimuma attiecību tiesiskais regulējums ir aktuāls un būtisks cilvēktiesību, vienlīdzības un ģimenes tiesību kontekstā. Šīs attiecības arvien plašāk tiek atzītas un regulētas dažādās valstīs, taču process joprojām ir sarežģīts un atkarīgs no valstu politiskajām, sociālajām un reliģiskajām normām. Viendzimuma attiecību tiesiskais regulējums ietver ne tikai laulību vai partnerattiecību atzīšanu, bet arī jautājumus par ģimenes tiesībām, bērnu audzināšanu un aizsardzību, un par sociālajām tiesībām. Darbā tiek analizēti normatīvie akti Latvijā un ārvalstīs, analizētas problēmas viendzimuma attiecību tiesiskajā atzīšanā un piedāvātas likumdošanas uzlabojumu perspektīvas. Darbā izmantotās pētnieciskās metodes: •Salīdzinošā metode; •Vēsturiskā metode; •Aprakstošā metode.

The legal regulation of same-sex relationships is a relevant and significant issue in the context of human rights, equality, and family law. These relationships are increasingly recognised and regulated in various countries, yet the process remains complex and dependent on the political, social, and religious norms of each state. The legal regulation of same-sex relationships includes not only the recognition of marriage of registered partnerships but also matters concerning family rights, child upbringing and protection, and social rights. This work analyses normative acts in Latvia and abroad, examines problems related to the legal recognition of same-sex relationships, and offers perspectives on possible legislative improvements. Research methods used in the study: •Comparative method; •Historical method; •Descriptive method.
