2008. gada 1. janvārī ir stājies spēkā „Maksātnespējas likums” . Kā galvenais jaunā likuma mērķis ir sabalansēt parādnieka un kreditora intereses un veicināt maksātspējas atjaunošanu, ko problemātiski bija veikt pastāvot līdzšinējam maksātnespējas procesa tiesiskajam regulējumam.
Darba mērķis ir analizēt un izvērtēt „Maksātnespējas likumā” ietvertos Latvijas Republikas tiesību sistēmai pavisam jaunos tiesību institūtus – fizisko personu maksātnespēju un tiesiskās aizsardzības procesu, kā arī juridisko personu maksātnespējas procesa noteikumu īpatnības. Darbā tiks vispārīgi veikts arī „Maksātnespējas likuma” normu izvērtējums, apskatot to atbilstību Eiropas Padomes 2000.gada 29.maija regulai Nr.1346/2000 par maksātnespējas procedūrām. At 1 January 2008 the new “Insolvency law” of Latvian republic came into force. The main target of new law is to develop a balance between debtor and creditors favors and stimulate renewal of solvency that was a problematic object with old insolvency process regulations. This works theme is “Insolvency process features in new Insolvency law” and it is very actual topic because new Insolvency law establish a number of new legal provisions in Latvian legislation. Those novelties where already ground for contentions when this law was only a draft plan.
Author reviews and highlights Insolvency law complemented list of insolvency indications that is essential betterment because it reduces potentiality to use insolvency process for collection of debts instead of using lawful measures that are tailored to this purpose and also turns down the possibility of ungrounded claims of insolvency just to prejudice the debtor.
