Ieķīlātas kustamas lietas atsavinājums

Abstract

Bakalaura darbs ir strukturēts divās nodaļās. Bakalaura darba pirmajā nodaļā analizēts ķīlas tiesību un tam līdzīgo tiesību jēdzienu saturs, apskatīti vispārīgie ķīlas tiesību veidi gan romiešu tiesībās un anglo-amerikāņu tiesību sistēmā, gan, protams, Latvijā, īpašu vērību veltot Latvijā esošo vispārīgo ķīlu veidu (rokas ķīlas un lietošanas ķīlas) priekšmeta – kustamu lietu – satura un tiesiskā regulējuma analīzei. Bakalaura darba otrajā nodaļā analizēts atsavinājuma jēdziens Latvijas tiesībās un atsevišķu kustamu lietu ķīlas priekšmetu atsavināšanas kārtība, tiesiskais regulējums un tiesu prakse saistībā ar ieķīlātu lietu atsavināšanu. Bakalaura darbā vērtēts tādu jēdzienu kā „ķīlas tiesības”, „ķīlas priekšmets”, „atsavinājums” saturs, un, konstatējot Latvijas tiesību aktos sastopamo jēdziena „atsavinājums” satura dažādību, izvirzīta vienota „atsavinājuma” definīcija. Kustamu lietu ieķīlāšanas īpatnību un ķīlas priekšmeta atsavināšanas kārtības analīzes rezultātā tiek iezīmētas galvenās problēmas un piedāvāti iespējamie risinājumi. Meklējot risinājumus identificētajām problēmām, bakalaura darbā ieskicēta Latvijas tiesu prakse, kā arī dažu ārvalstu kustamu lietu ķīlu veidu tiesiskais regulējums, norādot uz atšķirībām ar Latvijas tiesisko regulējumu. Bakalaura darbā tiek pausta atziņa, ka ir nepieciešama īpaša kustamu lietu ķīlas reģistra ieviešana vai esošā Komercķīlas likuma grozīšana, kas ļautu personām, kas nav komersanti, arī ieķīlāt kustamas nereģistrējamas lietas Komercķīlu reģistrā. Papildus tam piedāvāti arī atsevišķu tiesību normu redakcionāli labojumi.

The present BA paper “Alienation of pledged movable property” analyses the general types of movable property pledges, the notion of alienation, its legal basis, and also examines the case-law in the area of alienation of movable property in Latvia.

The present BA paper has the twofold structure. Chapter 1 of the paper attempts to analyse the content of pledge right and comparable legal phenomena. The list of types of pledge in Roman law as well as Anglo-Saxon legal system is given, with the emphasis upon the specific types of pledges of movable property used in Latvia (i.e., possessory pledge and usufructuary pledge) and the applicable legal regime. Chapter 2 analyses the notion of alienation in Latvian law, the detailed rules with regard to alienation of certain movable property, as well as the appropriate case-law. The content of notions ‘pledge right’, ‘the object of pledge’ and ‘alienated property’ is examined. Upon finding that the uses in Latvian law of these notions diverge, a unified definition for ‘alienation’ has been proposed. The analysis of the particularities of the alienation of movable property and those of pledging particular types of property the main problems have been identified, as well as some solutions are offered. In so doing, the case-law of Latvian courts has been touched upon, and some attention has been paid to the differences in legal instruments that regulate alienation of pledged movable property abroad and in Latvia.

The conclusion that could be drawn from the present BA paper is as follows: it seems necessary to introduce a special register of pledged movable property or amend the existing „Law on Commercial Pledge” to enable the persons other than traders to pledge movable property within the Commercial Pledge Register. Besides, some editorial amendments to several legal provisions are suggested.
