Darba un atpūtas laiks

Abstract

Bakalaura darba tēma ir „Darba un atpūtas laiks”. Darbam tika izvirzīts mērķis – atspoguļot darba un atpūtas laika tiesisko regulējumu, tā piemērošanu praksē un norādīt uz nepilnībām Latvijas Republikas normatīvajos aktos. Darba mērķim tik pakārtoti darba uzdevumi – skaidrot darba un atpūtas laika jēdzienus un to veidus; apskatīt darba laika organizāciju un tā tiesisko regulējumu; analizēt darba un atpūtas laika esošo praksi un ar to saistīto problemātiku. Bakalaura darbs veltīts darba un atpūtas laika tiesiskajam regulējumam, analizējot tā tiesību institūtus. Lai darba un atpūtas laiku reglamentējošās normas Darba likumā būtu precīzi un saprotami nodefinētas, darba izstrādes rezultātā tika secināts, ka ir nepieciešams tās izteikt jaunā redakcijā, papildināt vai grozīt, nodrošinot vienveidīgu un pareizu šo normu piemērošanu. Darba struktūru veido trīs nodaļas, kurās apskatīts darba laika un atpūtas laika jēdziens, prakse un ar to saistītā problemātika, kā arī darba laika organizācijas tiesiskais regulējums. Katras nodaļas temats tiek apskatīts no teorētiskās un no praktiskās puses. Autore darbā izmanto iegūtās teorētiskās zināšanas, papildinot tās ar praktisko pieredzi, veicot savus tiešos pienākumus savā darba vietā. Bakalaura darba struktūru pamato loģisks temata izklāsts un analīze, kā arī darbā analizējamo jautājumu reglamentācijas secība Darba likumā.

Bakalaura darbs ir izstrādāts uz 77 lappusēm, tajā ietveri 4 attēli, 2 tabulas un 8 pielikumi. Darba izpildē izmantoti 56 literatūras avoti un juridiskie akti.

The topic of this Bachelor’s Thesis is “Working Time and Rest Time”. The objective of the thesis is to overview legal regulation of working time and rest time, its practical implementation, as well as to identify inconsistencies in laws and regulations of the Republic of Latvia regarding the issue. Tasks of the thesis corresponding to the objective are as follows: to clarify notions and types of working time and rest time, to overview organisation of working time and its legal regulation; to analyse current practices of organising working time and rest time, as well as related problems. The Bachelor’s Thesis is focused on legal regulation of working time and rest time as far as the analysis of legal institutions is concerned. The thesis concludes that in order to define laws and regulations governing working time and rest time precisely and correctly, it is necessary to amend or restate these laws and regulations, ensuring their uniform and correct implementation. The thesis comprises three parts, where notions of working time and rest time are examined, including their implementation and related problems, as well as legal regulation of organisation of working time. Each part deals with one particular issue and overviews it from both theoretical and practical aspects. The author applies acquired theoretical knowledge in combination with practical experience from work place in the thesis. The paper is structured in line with the logical sequence of the analysed issues as they appear in the Labour Law of Latvia.

Total size of the thesis is 77 pages, including 4 figures, 2 tables and 8 appendices. The thesis incorporates 56 referenced sources and legal acts.
