dc.description.abstract | 2009. gada 1. decembrī spēkā stāsies Lisabonas līgums, ar kuru tiks grozīts Līgums par Eiropas Savienību (ES) un Līgums par Eiropas Kopienu. Būtisks jaunievedums pamatlīgumu saturā būs Līguma par ES 50. pants, kurā atrunātas valsts tiesības brīvprātīgi izstāties no ES.
Bakalaura darba mērķis ir analizēt valsts izstāšanās no ES tiesības gan saskaņā ar pašreiz spēkā esošajiem pamatlīgumiem, gan pēc Lisabonas līguma spēkā stāšanās ar mērķi sniegt novērtējumu, vai pastāv ievērojamas izmaiņas juridiskajos priekšnosacījumos, kas ietekmē valstu iespējas pārtraukt savu dalību ES. Galvenie secinājumi ir, ka izstāšanās panta iekļaušana pamatlīgumos norāda uz ES kā suverēnu valstu apvienību, un šis pants paredz daudz plašākas izstāšanās tiesības nekā pašreiz pastāvošās, no ES pamatlīgumiem un starptautiskajām tiesībām izrietošās valsts tiesības. | en_US |
dc.description.abstract | In 1 December 2009 Lisbon Treaty which amends the Treaty on the European Union and the Treaty establishing the European Community will come into force. A significant novelty in the Treaties will be the new Article 50 in the Treaty on the European Union which stipulates the rights of a Member State to a voluntary withdrawal from the EU.
The aim of the bachelor’s paper is to analyze the withdrawal rights both as they exist now according to the current Treaties as well as after they are amended by the Lisbon Treaty in order to give an evaluation whether there are substantial changes in the legal aspects of the withdrawal from the EU. The main conclusions are that the withdrawal clause in the Lisbon Treaty underlines the EU as a union of sovereign states and that the said clause provides Member States with larger power with regards with withdrawal than they hold according to the current Treaties and international public law. | en_US |
