Vekseļu aprites tiesiskais regulējums un ar to saistītās problēmas

Abstract

Bakalaura darba tēma ir „Vekseļu aprites tiesiskais regulējums un ar to saistītās problēmas”. Darba mērķis ir studējot gan Latvijas, gan ārvalstu tiesību zinātnieku un īpaši tirdzniecības un vekseļtiesību zinātnieku autoru darbus, publikācijas periodikā, ar vekseļtiesībām saistītos Latvijas Republikas normatīvos aktus, kā arī pētot un analizējot tiesu praksi, izpētīt vekseļtiesību izcelsmi un vēsturisko attīstību, atsevišķu vekseļtiesību sistēmu būtiskākās pazīmes un atšķirības, vekseļtiesību avotus un vekseļu aprites tiesisko regulējumu, pētīt un analizēt atsevišķus vekseļtiesiskos institūtus, kā arī izanalizēt ar vekseļu apgrozību saistītās problēmas un sniegt to iespējamos risinājumus. Darbā netiks apskatīti tādi ar vekseļtiesībām saistīti jautājumi kā vekseļa dublikāti un noraksti, kā arī vekseļu un vekseļa protestu aktu nozušanas, nozagšanas vai iznīcināšanas juridiskās sekas. Tēmas aktualitāte pamatojama ar vekseļu apritē vērojamo straujo pieaugumu šā brīža ekonomiskajā situācijā, kad uzņēmējiem un privātpersonām globālās ekonomiskās krīzes dēļ nav pieejama salīdzinoši vienkārša, ātra un ērta kreditēšana apgrozāmo līdzekļu ieguvei. Vekselis ir arī nozīmīgs finanšu instruments gan iekšzemes, gan jo īpaši starptautiskās tirdzniecības nodrošināšanā, jo ļauj veikt savstarpējus norēķinus un naudas pārvedumus, neizmantojot skaidru naudu. Ņemot vērā vekseļtiesību komplicēto uzbūvi un vekseļa formālo dabu, kā arī vekseļa plašās izmantošanas iespējas civiltiesiskajās attiecībās un tirdznieciskajā apgrozībā, būtiski ir pārzināt un attiecīgi pareizi piemērot vekselim un vekseļu apgrozībai kopumā raksturīgās formālās prasības, kā arī novērst esošās neskaidrības un pretrunas normatīvajā regulējumā.

The topic of this bachelor’s project is “Legal provisions for the turnover of promissory notes and bills of Exchange and problems related thereto”. The aim of the project is to research the branch of the law concerning promissory notes and bills of exchange, the origins of the law, historical development, the main features and differences in systems of this branch, the sources of law and legal provisions for the turnover, to research and analyze separate institutes of this branch as well as to analyze the problems concerning the turnover and furnish possible solutions to them. The author is not examining such topics as duplicate and copy bills of exchange as well as the legal consequences of disappearance, theft or liquidation of bills of exchange and the acts of their protest. This topic is important for following reasons. The turnover of bills of exchange has been rapidly growing during the present economic conditions when the entrepreneurs and individuals lack comparative, easy, rapid and convenient means of credit due to global economic crisis. A bill of exchange is an important financial instrument to secure both domestic and international trade as it enables entities to settle accounts and make transfers without the use of hard currency. Due to complexity of the bills of exchange law, the formal nature of bills of exchange as well as the broad scope of its utilization in both civil and trade turnover, it is essential to know and correctly apply the common formal requirements for bills of exchange and their turnover as well as eliminate any existing uncertainties and contradictions within the legal regulation.
