Procesa virzītāja sadarbība ar speciālistiem krimināllietās par ceļu satiksmes noteikumu pārkāpumiem

Abstract

Latvijā ik gadu notiek simtiem ceļu satiksmes negadījumu. Statistika ir biedējoša, un, lai arī tas, iespējams, ir saistīts ar laika gaitā pieaugošo automašīnu un citu transportlīdzekļu skaitu, taču sabiedrībai būtu laiks piedomāt pie šīs šausminošās statistikas un tā, kā to mazināt. Problēma valstī ar lietu izskatīšanas ilgumu ir liela, tādēļ, ja, vismaz pagaidām, nav iespējas samazināt noziedzīgo nodarījumu skaitu valstī, būtu jāatrod līdzekļi, lai izskatīšanu tiesās paātrinātu. Sekmēt procesa virzītāja un eksperta sadarbību kriminālprocesā varētu būt viens no līdzekļiem ātrākai lietu izskatīšanai tiesā. Tā kā ceļu satiksmes negadījumu skaits valstī gada laikā ir ļoti liels un nesarūk, bet tieši otrādi – palielinās, tad bakalaura darba mērķis ir apskatīt juridisko literatūru un ar ceļu satiksmes negadījumiem saistīto tiesu praksi, lai, īpaši koncentrējoties uz procesa virzītāja un speciālista sadarbību kriminālprocesā, noskaidrotu šādas sadarbības nepieciešamību, mērķi, kā arī indentificētu sadarbības pozitīvās un negatīvās iezīmes. Darba pirmajā nodaļā tiek aplūkoti termini „procesa virzītājs” un „ceļu satiksmes negadījums” un „ceļu satiksmes noteikumu pārkāpums”, kā arī to nozīmē kriminālprocesā, procesa virzītāja tiesības un pienākumi. Darba otrajā nodaļā tiek apskatīti jēdzieni „speciālists”, „eksperts” un „ekspertīze”, kā arī tiek pētīta procesa virzītāja un speciālista sadarbība, kas ir bakalaura darba galvenais uzdevums. Šī sadarbība tiek pētīta, par pamatu ņemot Latvijas tiesu praksi – dažādus spriedumus un lēmumus, kā arī citus lietu materiālus, un analizēta kā sekmīgs pamats visu ceļu satiksmes negadījumu apstākļu noskaidrošanā. Trešajā nodaļā apskatīti tieši tiesu medicīnas eksperti un to uzdevumi un vieta kriminālprocesā, jo bieži ceļu satiksmes negadījuma rezultāts ir cietušā nāves iestāšanās, kur tiesu medicīnas eksperta piedalīšanās ir ļoti svarīga, lai noteiktu negadījuma apstākļus.

Every year in Latvia occures hundreds of road accidents. The statistics are deterrent, and althought maybe it happens because of big number of cars nowadays in general, but all society should start to think why is the statistics so terrifying and should start doing something. There is a big problem in country, because of such a long term cases, and that is why it is necessary to hasten this term, if for now it is not possible to reduce the huge number of crimes in general. To promote person`s, following the procedure, cooperation with experts might be one of the ways to do that. Since the number of road accidents in country is very high and every year it is not getting smaller, but the other way round – getting bigger, the aim of this bachelor work, is to go through the legal literature and practice, to find out why is the cooperation between expert and person, following the procedure, necessary, to find out the aim of this cooperation and to identify and analize the positive and negative aspects of it. The first chapter of the bachelor work is about defining the subject ”person, following the procedure”, ”road accident” and ”irregularity of terms of road traffic” and finding out what is the meaning of them, also to find out rights and duties of person, following the procedure. The second chapter is about defining the subjects „expert” and „examination” and, which is the main purpose of this bachelor work, looking through the cooperation between persons, following the procedure, and experts. The cooperation in this chapter is examined, based on cases of road accidents, which happened in Latvia, based on different resolutions and sentences and also other materials. Within the third chapter, there is being inspected the subject „expert of forensic medicine”, their tasks and place in criminal procedure, because unfortunately it is very often, when people die in road accidents, that why expert of forensic medicine is needed and cooperation with him is very important.
