Īpatnības valsts aģentūru tiesiskajā regulējumā

Abstract

Diplomdarba tēma - Īpatnības valsts aģentūru tiesiskajā regulējumā, mērķis - atklāt valsts aģentūru tiesiskā regulējuma īpatnības un atsevišķu tiesību normu piemērošanas praksi. Aplūkota valsts aģentūru izveidošana, tiesiskā regulējuma attīstība, diskusijas Publisko aģentūru likuma izstrādāšanas laikā, ekspertu ieteikumi, ārvalstu pieredze. Analizēti jautājumi par valsts aģentūru sniegtajiem publiskajiem pakalpojumiem, to atbilstību tiesību aktiem, iespējas ziedot un dāvināt valsts aģentūrām pieļaujamību, darba samaksas noteikšanu valsts aģentūru darbiniekiem, problēmām, kādas pastāv tiesību aktu piemērošanā. Konstatēts, ka dažu valsts aģentūru konsultatīvajām padomēm tiek noteikta neatbilstoša kompetence, izdarīts secinājums par valsts aģentūru darbības uzraudzības atbildīgo amatpersonu atjaunošanas lietderību.

The theme of the diploma paper is “Speciality of Juridical Regulation of State Agencies”. The goal is to reveal these specialties and to research how several legal provisions are applied in practice. The paper gives an overview of development of juridical regulation of state agencies, foundation procedure of state agencies, discussions within the development process of Public Agency Law, suggestions of several experts and foreign experience. The paper also deals with questions concerning public services that are rendered by state agencies, contributing admissibility to state agencies, wage determination and problems in law applying process. The author has concluded that some Advisory Councils have been prescribed inadequate competence. The author concludes that it could be useful to re-establish such institute as senior sponsor.
