Latvijas konstitucionālo normu hierarhija

Abstract

Maģistra darbā aplūkota Latvijas konstitucionālo normu hierarhija. Formālās konstitūcijas normas ar augstāko juridisko spēku ir vispārējie tiesību principi. Nākamo hierarhijas līmeni veido Satversmes 1., 2., 3., 4., 6. un 77. pants un Deklarācija par Latvijas valsti. Savukārt zemākajā konstitucionālo normu hierarhija līmenī ir izvietojamas pārējās konstitucionālās normas (pārējās Satversmes normas, Deklarācijas „Par Latvijas Republikas neatkarības atjaunošanu” normas, konstitucionālais likums „Par Latvijas Republikas valstisko statusu”, kā arī Satversmes 68. panta otrās daļas procedūrā pieņemtie likumi). Papildus tam maģistra darbā ir analizēta profesora Hansa Kelzena Pamatnormas teorija un normatīvo aktu hierarhijas ideja. Tāpat autors aplūkojis Latvijas pievienošanās Eiropas Savienībai ietekmi uz konstitucionālo normu hierarhiju.

The constitutional legal norms can be organised in a hierarchical structure. The place of the constitutional legal norm in the hierarchy depends on the legal force of the norm. The main legal norms of the Constitution in the formal sense are the General Principles of Law. The next level of hierarchy is formed by fundamental norms of Constitution, namely – Articles 1, 2, 3, 4, 6 and 77 of the Constitution of the Republic of Latvia and The Declaration on the State of Latvia. The inferior level of hierarchy consists of other constitutional legal norms. In the Master Thesis the author also analyses the theory of Kelsen’s Basic Norm and professor’s Kelsen concept of the hierarchy of the legal acts. The author pays attention to the influence of Latvia’s accession to the European on the hierarchy of the constitutional legal norms of Latvia.
