Straujas finanšu situācijas pasliktināšanās rezultātā Latvijā ir pieaudzis parādu piedziņas lietu skaits, kas rosināja veikt pētījumu un izstrādāt maģistra darbu „Nekustamā īpašuma pārdošana izsolē un ievešana nekustamā īpašuma valdījumā”. Darba mērķis ir noskaidrot piespiedu izpildes līdzekļu - piedziņas vēršana uz nekustamo īpašumu un ievešana valdījumā, normu saturu, to nepilnības un trūkumus, kā arī to atbilstību sprieduma piespiedu izpildes institūta būtībai un mērķim. Lai sasniegtu darbā izvirzīto mērķi, tika pielietotas tiesību teorijā sastopamās tiesību normu iztulkošanas metodes, ar kuru palīdzību tika analizēti Latvijas normatīvie akti, tiesu prakse un vairāku autoru zinātniskās publikācijas. Darbs sastāv no trīs nodaļām. Pirmajā nodaļā tiek apskatīta piespiedu izpildes līdzekļu būtība, mērķis un tā vēsturiskā attīstība. Darba otrās nodaļas piecās apakšnodaļās tiek apskatīts nekustamā īpašuma izsoles process un normatīvais regulējums. Trešajā nodaļā apskatīts ievešanas nekustamā īpašumā valdījumā process un normatīvais regulējums. Autore darba ietvaros konstatē norādītā normatīvā regulējuma nepilnības un sniedz priekšlikumus to efektīvai novēršanai. Priekšlikumi izveidoti kā pastāvošā normatīvā regulējuma grozījumi. Rapid deterioration of financial situation in Latvia has resulted in increased number of debt recovery proceedings, and such fact has motivated to carry out a study and develop the Master’s thesis “Sales of Immovable Property in an Auction and Placing in Possession of Immovable Property”. The goal of the Present paper is to clear out the content of norms for enforcement remedies (real property foreclosure and admittance to possession), and their imperfections and drawbacks, as well as their compliance with the essence and purpose of compulsory enforcement institution. In order to achieve the goal set forward in the paper, methods of interpretation of legal norms commonly found in law theory were used for analysis of Latvian regulatory enactments, judicial practice and scientific publications of several authors. The Paper consists of three Chapters. The first Chapter describes the essence, purpose and historical development of compulsory enforcement remedies. Five sections of the second Chapter contain description of the real estate auctioneering process and its legal regulatory regime. The third Chapter gives a survey of the process for admittance to possession of real property and its regulatory regime. The Author has established within the framework of the paper imperfections of the above-mentioned regulatory regime and made proposals for efficient elimination thereof. Such proposals are made in the form of amendments to the existing regulation.
