Pēc valsts neatkarības atgūšanas, strauji attīstoties Latvijas ekonomikai ar vien vairāk radās arī nepieciešamība risināt strīdus tiesas ceļā. Attīstījās arī tiesu sistēma, taču procesuālo principu ieviešana un ievērošana joprojām ir pilnveidošanās procesā, aktualizējas tādi procesuālie principi kā ekonomiskā lietderība, lietas izskatīšana saprātīgā termiņā, vienlaicīgi saglabājot lietu izskatīšanas procesa un spriedumu kvalitāti, lai tas atbilst galvenajam principam – tiesības uz taisnīgu tiesu.
Pētījuma mērķis ir veikt tiesu sistēmas izpēti kontekstā ar principa tiesības uz taisnīgu tiesu ievērošanu, atrast procesa likuma nepilnības, izpētīt šī principa elementu attiecināmību uz kasācijas instances procesu.
Darbā ir atspoguļotas tās normas, kuras neatbilst principam tiesības uz taisnīgu tiesu, ir piedāvāti šo normu grozījumi. Analizēta kasācijas instances spriedumu pieņemšana, uzsvērta nepieciešamība ņemt vērā pušu ekonomisko interesi lietas izskatīšanas rezultātā. Apskatītas starptautiskās normas, it sevišķi Eiropas normatīvi, kuriem ir tendence procesu vienkāršot un paātrināt, ievērojot personas tiesības uz taisnīgu tiesu. After the process of regaining the state independence, the economy of Republic of Latvia have developed and there arising more necessity to find solutions of disagreements in the court institutions. Also justice system proceeded, but implementation and respect of particular judicial principles is still under process of improving. For example, the topical principles are economical advisability and hearing the case in reasonable terms, but at the same time retaining quality of the trial and verdict, are becoming an issue to meet the main principle- the right to justice trial.
The aim of this research is to make study of the justice system in context with the principle of right to justice trial, and as well as to find the imperfections in the rules of process law, besides to researching relevance of this principle to the cassation process.
This head work disclosing the standards, who are in contradiction with the principle of the right to justice trial, amendments for those standards are offer in this research. Analysis of the cassation process have made with emphasis on necessity to take into account economical interests of the parts involving in the court process. Reviewing of the international standards, particulary European regulatory, who has tendency to make the court trial more simplify and expedite with respect to the person’s right to justice trial, is presented.
