Diplomdarba mērķis ir analizēt nerezidenta tiesisko stāvokli Latvijas Republikas nodokļu tiesībās. Tas tiek sasniegts, pētot nodokļu tiesību doktrīnu, nacionālos un Eiropas Savienības normatīvos tiesību aktus, Latvijas noslēgtās nodokļu konvencijas, kā arī Eiropas Justīcijas tiesas spriedumus. Darbā tiek pētīti ar nerezidenta jēdziena un pastāvīgās pārstāvniecības koncepcijas definēšanu saistītie problēmjautājumi. Tiek analizēta nerezidenta – fiziskās personas un pastāvīgās pārstāvniecības apliekamais ienākums, tāpat trešajā nodaļā tiek pētīta apliekamā ienākuma noteikšana. Diplomande ierosina noteikt likumdošanā darbiniekiem izmaksājamās akciju opcijas kā ienākumu no algota darba. Piemērojot nodokļu konvenciju, tiek ieteikts konstatēt ienākumu gūšanas faktu, nevis saimnieciskās darbības veikšanu, tam piešķirt izšķirošo nozīmi. The object of the diploma work is to analyse the status of non-resident in tax law in the Republic of Latvia. The object is met through examining the current and relevant doctrine in tax law, studying national and EU legislative acts, as well as periodicals and cases of European Court of Justice.
The diploma work contains analyse of problem issues of defining concept of “non-resident” and “permanent agency”. The second and the third part of work deals with chargeable income of non-resident as physical person and chargeable income of permanent agency. The rest is dedicated to research methods of chargeable income.
There is reached proposition to amend regulations of Cabinet of Ministers Nr. 112 with a new point 3.5.1 in order to clarify that stock options granted to employees of enterprise must be regarded as salary income and therefore payroll tax withhold.
Latvian law make stress on determination of economic activity in order to establish case of chargeable income, whereas tax treaties make stress on fact of gaining income. Hereby applying tax treaties fact of gaining income is regarded as priority.
