Piespiedu darbs un tā izpildes problēmas

Abstract

Savā darbā autore, izskaidrojot piespiedu darba būtību un aprakstot problēmas, kas saistītas ar tā izpildi, nosaka darba uzdevumu – iepazīties ar piespiedu darba būtību, tā normatīvo regulējumu, tā izpildes praksi un problēmām, kas saistītas ar tā izpildi, kā arī iepazīties ar iespējamiem piedāvājumiem saistībā ar piespiedu darba izpildes uzlabošanu Latvijā. Darba mērķis ir izdarīt secinājumus vai piespiedu darbs ir spējīgs sasniegt soda mērķi, vai šāds soda veids ir nepieciešams Latvijas sodu sistēmā, un kas būtu jāizdara lai padarītu piespiedu darba izpildi efektīvāku. Darba tapšanas laikā autore konstatē trīs pamatproblēmas: 1) sabiedrības apziņā piespiedu darbs nav saistīts ar soda jēdzienu, tāpēc šis soda veids nespēj sasniegt soda mērķi – ģenerālo prevenciju; 2) piespiedu darbu bieži piespriež personām, kas nav spējīgas to izpildīt, tāpēc šis soda veids nespēj sasniegt soda mērķi – speciālo prevenciju; 3) sakarā ar nepilnībām piespiedu darba normatīvajā regulējumā, darba devēji izvairās nodrošināt darba vietas tām personām, kas sodītas ar piespiedu darbu. Darba tapšanas laikā autore piedāvā augstāk minēto problēmu risinājumus: 1) jāturpina informēt sabiedrību par piespiedu darba būtību, tā izpildes kārtību un par iespējamās sekām, ja piespiedu darbs netiks pildīts; 2) jāizdara grozījumi normatīvajā regulējumā, paredzot ierobežojumus piespriest piespiedu darbu personām, kas to nebija izcietušas iepriekšējo reizi vai kas tiek tiesātas otrreiz; 3) jāizdara grozījumi piespiedu darba izpildes normatīvajā regulējumā paredzot īpašas kompensācijas tiem darba devējiem, kas nodrošina darbavietas ar piespiedu darbu notiesātajiem.

In the degree thesis named above, author, while clearifying the meaning of forced labour and describing problems connected with its execution, sets up the thesis task – to get acquainted with essence of forced labour, its normative regulation, practice of its execution and arising problems regarding its execution, as well as to get acquainted with possible advices on the matter of modyfying execution of forced labour in Latvia. The goal of the thesis is to make a decision wheather forced labour is able to reach the aim of punishment, weather such kind of punishment is necessary for Latvian legal system and what should be done in order to make execution of forced labour be more affective.

During the course of the thesis author names three main problems: 1) in consciousness of public society such kind of punishment as forced labour is not connected with the meaning of punishment, that is why this kind of punishment is not able to reach the aim of each punishment – general prevention; 2) forced labour is usually imposed to people, who are not able to execute it, that is why this kind of punishment is not able to reach the aim of each punishment – special prevention; 3) due to the shortcommings of the normative regulation regarding forced labour local employers avoid employing people sentenced to forced labour.

Also during the course of the thesis author proposes the solutions to the mentioned problems in question: 1) public authorities should continue informing public society about the essence of forced labour, the order of its execution and the possible consequences if forced labour is not executed in the manner prescribed by law; 2) ammendments should be made in normative regulation of forced labour regarding restrictions to impose forced labour to those people, who have not executed it previous time or have been involved in court proceedings as defendants for the second time; 3) ammendments should be made in normative regulation of execution of forced labour regarding special compensations for those employers who employ people sentenced to forced labour.
