| dc.description.abstract | Bakalaura darba tēma ir cietsirdīga izturēšanās pret dzīvniekiem. Par darba aktualitāti liecina darbā apskatītā tiesu prakse, kas atklāj cilvēka nežēlību pret dzīvniekiem, kā arī dzīvnieku aizsardzības organizāciju plašais darba apjoms, kas jāiegulda dzīvnieku aizsardzības jomā.
Darba mērķis ir veikt pētījumu par cietsirdīgas izturēšanās pret dzīvniekiem situāciju Latvijā, izpētot vietējos un starptautiskos tiesību aktus dzīvnieku aizsardzības jomā.
Darbā tiek apskatīts un analizēts Krimināllikuma 230. pants, kas aizliedz cietsirdīgu izturēšanos pret dzīvniekiem, kā arī ārvalstu krimināllikumu attiecīgie panti, precīzāk, Krievijas, Austrijas, Francijas un Igaunijas krimināllikumi.
Darba ietvaros autore atspoguļo reālus cietsirdīgas izturēšanās pret dzīvniekiem gadījumus no Latvijas Republikas tiesu prakses un sniedz attiecīgās tiesu prakses izvērtējumu.
Pēc iepazīšanās ar ārvalstu krimināllikumiem un to analīzes, autore sniedz priekšlikumus Krimināllikuma 230. panta jaunai redakcijai, tas ir, atrunāt šī nodarījuma izdarīšanu mazgadīgo klātbūtnē.
Nākotnē būtiskākais ir sasniegt to mērķi, kas ir paredzēts gan starptautiskajos, gan vietējos dzīvnieku aizsardzības tiesību aktos. | en_US |
| dc.description.abstract | The subject of this Paper is the human cruelty towards animals. The topicality of the subject is supported by the examination of the case law in the Paper revealing the animal abuse and also by the fact that the animal protection organizations have a huge workload to cope with.
The aim of the Paper is to carry out a research on the cruelty to animals in Latvia by the study of the state and international legislation in the field of animal protection.
Article 230 of the Latvian Criminal Law forbidding cruelty to animals and also other relevant foreign criminal law articles (such as Russian, Estonian, Austrian and French) are being analyzed throughout the Paper.
The author reports and after also evaluates the authentic cases of the cruelty to animals from the case law of the Republic of Latvia.
Having examined the foreign criminal law, the author proposes to revise Article 230 by stipulating the act of such an offence in the presence of minors.
It is concluded that in the future the most important issue is to pursue the aim set by the international and state animal protection legislation. | en_US |
