dc.description.abstractBakalaura darba autore darbā analizē pašreizējos patentu piešķiršanas un administrēšanas veidus Eiropas Savienībā, kā arī to trūkumus. Darbā uzmanība koncentrēta uz Kopienas patenta projekta izveides attīstības nepieciešamības analīzi vienotas patentu sistēmas izveidošanā. Vienlaikus autore izanalizē problemātiku, kas saistīta ar Kopienas patenta projekta saskaņošanu un kompromisa meklējumiem šāda patenta izveidošanai. Tēmas aktualitāti apliecina tas, ka Kopienas patenta projektu izveide datējama jau no pagājušā gadsimta, kad Eiropas Komisija kopā ar Eiropas Kopienas dalībvalstīm meklēja risinājumus Kopienas patenta sistēmas implementēšanai. Tāpat bakalaura darbā analizēti alternatīvie risinājumi, kas plāno novērst trūkumus Eiropas patentu piešķiršanai un tālākai uzturēšanai. Darbā analizēti nacionālie un starptautiskie normatīvie tiesību akti, Eiropas Komisijas, Eiropas Savienības Padomes, Eiropas Savienības prezidējošo valstu izstrādātie Kopienas patenta projekti un starptautiskie līgumi kā alternatīvs risinājums Kopienas patenta projektam. Pētījuma rezultātā maģistra darba autore nonāca pie secinājuma, ka Kopienas patenta projektam pastāv vairāki iemesli, kādēļ projekts nav apstiprināts, kas galvenokārt saistīts ar valodu režīmu un vienotas patentu tiesvedības iekārtas izveidi. Tāpēc darba autore piedāvā veikt korekcijas un papildinājumus Kopienas patenta projektā un starptautisko līgumu projektos, izmantot alternatīvus strīdu risināšanas veidus, piedāvā savu risinājumu Eiropas patentu tiesas pirmās instances uzbūvei, izmantot videokonferences, lai sekmētu personu piekļuvi tiesai.en_US
dc.description.abstractThe author of bachelor’s paper analyses types and problems of the current European patent systems in Europe in order to find out the necessary improvements to be made in order to create a united and unified patent system in the European Union. The patent protection is ensured in the European Union by three systems, neither of which is based on Community legislative instruments. Additionally author analyses the implementation process of the Community patent about which no common compromises can be reached until now. The Community patent is intended to bring together the bundle of protection rights resulting from the grant of the Community patent and merge them into a single, unitary and autonomous protection right valid throughout the Community. Reasons why the Community patent has not adapted until yet are due to high expenses of the translation arrangements until now and due to reason that the Member States can not reach a conclusion on the type of Community patent litigation that should be established within the European Union. The author has come to conclusions that there are several advantages of the unitary Community patent system. One can obtain protection for inventions immediately for the whole of the Community under a single procedure, the management of rights would be greatly facilitated since there would no longer be any national phase and to this have effect of reducing costs. The Community patent system would avoid the need for infringement actions to be brought in each national Member State and would increase the legal certainty through creation of one single Community patent court. Within the bachelor’s work the author have several proposals for the improvement of the implementation of the Community patent project that are related to the improvements of litigation system, improvements of the translation arrangements for patent claims, education of judges, introducing of alternative dispute resolution procedure, use of videoconferences within court procedures etc.en_US
