Maģistra darbā tiek raksturota un analizēta pierādīšanas subjektu izpratne, klasifikācija un viens no aktuālākajiem jautājumiem – pierādīšanas pienākums un pierādīšanas nasta kriminālprocesā, kā arī izņēmumi, kad pierādīšanas nasta tiek pārnesta uz aizstāvību.
Maģistra darba mērķis ir analizēt pierādīšanas subjektu izpratnes problemātiku, noskaidrot un izpētīt, kādi apstākļi ietekmē pierādīšanas pienākumu un tā pārnešanu, rast risinājumus pierādīšanas pienākuma īstenošanas problēmām no apsūdzības un aizstāvības aspekta.
Darbā analizēta tiesu prakse un izteikti secinājumi problēmu risinājumam, grozot un papildinot Kriminālprocesa likuma normas.
Kā būtiskākos atzinumus var minēt, ka tiesas iespējas izpildīt pierādīšanas pienākumu ir ierobežotas, kas var apgrūtināt gan Kriminālprocesa likuma 511. prasību izpildi, pierādīšanas nastas pārnešanas gadījumā, aizstāvībai nav pietiekamu iespēju un līdzekļu kā iegūt pierādījumus, kas apstiprinātu aizstāvības izvirzīto apgalvojumu. In Master Paper there has been characterised and analysed the sense, classification and one of the subject of proving and one of the most topical questions – obligation of proving and burden of proving in criminal proceedings, and exceptions, when burden of proving has been transferred to defence.
The goal of the Master Paper is to analyse problems of sense of the subject of proving, to make clear and investigate, what kind of circumstances make influence on obligation of proving and its transfer, to find solutions of problems of realisation of obligation of proving in aspects of prosecution and defence.
In the work there has been analysed jurisprudence and conclusions are expressed for solution of problems, by changing and supplementing standards of Criminal Procedure Law.
As the most essential resolutions there can be marked the fact that abilities of the court to fulfil obligation of proving are limited, and it can make fulfilment of standards of the Article 511 of Criminal Procedure Law more difficult, in case of transfer of obligation of proving the defence doesn’t have enough possibilities and means to get proofs that would approve statement established by the defence.
