Ārsta tiesības nesniegt pacientam medicīnisko informāciju, kas var pasliktināt pacienta veselības stāvokli

Pēdējos desmit gados Latvijas tiesās palielinās to pieteikumu skaits, kuru prasījumi ir saistīti ar ārstniecību. Viens no prasījumu pamatiem ir nepietiekoša pacienta informēšana ārstniecības laikā vai pēc tās. Mūsdienās viens no veiktās ārstniecības tiesiskuma novērtēšanas kritērijiem ir pacienta informēta piekrišana. Četri klasiskie izņēmuma gadījumi, kad šāda piekrišana nav vajadzīga, ir:
1)neatliekamā medicīniskā palīdzība, kad ārstēšana jāuzsāk nekavējoties, bet pacients sava veselības stāvokļa dēļ nespēj uztvert informāciju un pieņemt lēmumus;
2)pacienta rīcībnespēja, kad piekrišanu viņa vietā izsaka aizbildņi;
3)pacienta atteikšanās no informācijas;
4)ja medicīniskās informācijas sniegšana var pasliktināt pacienta veselības stāvokli.
Šajā darbā tiek pētīts šis pēdējais izņēmuma gadījums (ang. therapeutic privilege), kurš ir pazīstams lielākajā daļā valstu.

In this Masters thesis the author analyses different aspects of the therapeutic privilege that is known as one of the exceptions of principle of informed consent to medical care. First, author describes the historical background of this institute as well as main relevant medical deontological problems. Further she compares the definition and concepts of therapeutic privilege in law and medical right theory of Latvia, Germany, Russia, United Kingdom and United States of America. Secondly, the therapeutic privilege is viewed in light of patient rights. Thirdly, there is analysed the place of this institute in civil rights. Fourthly, the author analyses the preconditions and specialities of material liability. It is concluded that exercising of the therapeutic privilege as an exception of informed consent should be decreased as much as possible. Author offers and makes a suggestion to amend a appropriate law and to some interpretations.
