Zvērināta tiesu izpildītāja papildfunkcijas

Abstract

Maģistra darba tēma ir „Zvērināta tiesu izpildītāja papildfunkcijas”. Darba mērķis ir Latvijā un pasaulē divu populārāko tiesu izpildītāja papildfunkciju – faktu fiksēšanas un tiesu un citu dokumentu piegādes izpēte ar nolūku izstrādāt priekšlikumus šo funkciju normatīvā regulējuma un prakses pilnveidošanai Latvijā. Lai sasniegtu minēto mērķi, darbā risināti šādi uzdevumi: raksturots tiesu izpildītāja institūts un tā attīstība Latvijā, īpašu uzmanību veltot tiesu izpildītāja darbības pamatprincipu un funkciju analīzei; izpētīts faktu fiksēšanas un dokumentu piegādes tiesiskais regulējums, prakse un ar to saistītās problēmas; kā arī apskatītas šo papildfunkciju īpatnības ārvalstīs, izvērtējot šo īpatnību ieviešanas lietderību Latvijā.

The theme of the master’s paper is „Auxiliary Functions of Judicial Officer”. The aim of the paper is – the study of judicial officer’s two most popular auxiliary functions in Latvia and the world – fact recording and court and other document delivery with a purpose to develop suggestions for improving the normative regulation and practice of these functions in Latvia. To achieve the aforementioned aim, the paper deals with the following tasks: judicial officer’s institution and it’s development in Latvia is characterized, devoting a special attention to the analyses of the basic principles and functions of judicial officer profession; it studies the legal regulation and practice of fact recording and document delivery and the problems related to it; the paper also deals with the peculiarities of these additional functions abroad considering the usefulness of introducing these peculiarities in Latvia.
