Noziedzīgi nodarījumi datoru sfērā

Abstract

Diplomdarba nosaukums ir „Datornoziegumu un ar tiem saistītā tiesiskā regulējuma attīstības vēsture”. Darbs sadalīts 3 nodaļās ar apakšnodaļām. Darbā tiek izpētīta datornoziegumu vēsturiskā attīstība un to saturs, kontekstā ar šo jautājumu regulējošo tiesību normu veidošanās procesu starptautiskajā un Latvijas mērogā. 1.nodaļā tiek apskatīts jautājums par kibernozieguma fenomenu un sekots tā attīstībai no XIX gs. līdz pat XXI gs.. Tāpat arī apkopots Eiropas un pasaules valstu un Starptautisku organizāciju datornoziegumu regulējums starptautiskos aktos un zinātniskajos pētījumos. 2.nodaļa sastāv no divām apakšnodaļām, kur pirmajā tiek aplūkota U. Sībera izvirzītā ar informācijas tehnoloģiju attīstību un pārkāpumiem, noziegumiem šajā sfērā saistīto sešu likumdošanas viļņu teoriju. Otrajā tiek pamatota veikto izmaiņu nepieciešamība Krimināllikumā atbilstoši starptautiskajai Konvencijai par kibernoziegumiem.. 3.nodaļā tiek aplūkotas datornoziegumu attīstības tendences gan pasaulē, gan Latvijā, kā arī datornoziegumu atklāšanas problemātika XX gs. beigās un XXI.gs sākumā. Diplomdarba izstrādāšanas gaitā ir izstudēta pieejamā literatūra: monogrāfijas un raksti, publikācijas laikrakstos un internetā gan latviešu, gan krievu un angļu valodās. Salīdzināšanai un uzzināšanai izmantoti interneta resursi, kas ļauj plaši izpētīt darbā aizskarto tēmu, tai skaitā iepazīties ar daudzu zinātnieku pieredzi kibernoziegumu izpētes sfērā. Kopējais darba apjoms ir 51 lappuse.

The purpose of this work is to examine the historical aspects and development of computer crimes and legal regulation in the given field. Work consists of 3 chapters and consequent sub chapters. The work analyzes historic development and structure of computer related crimes, in line with the development of the relevant legal environment globally and in Latvia in particular. In the first chapter the question of the phenomenon of cyber crime and its development to present day is considered. In addition the governing of European and international legislation and researches regarding cyber crime are reviewed. The second chapter consists of two sub items in which is find out U. Sieber theory of the Main Waves of Computer Crime Legislation and in the next sub item specific necessity for changes in the Criminal law of Latvia are considered according to the Convention about cyber crimes. In the third chapter trends of development in cyber crime in Latvia and the world are reviewed, and problems in relation to disclosing those crimes. During research on the dissertation I have studied available literature: monographies and articles, including in newspapers and the Internet in the Latvian, Russian and English languages. For comparison and analysis purposes I have used internet resources that gave me a wide choice of material, and gave me unique opportunity to study this subject in depth, and to familiarize myself with experience of other scientists in battling cyber crime. This work consists of 51 pages.
