Jau gandrīz sešus gadus Latvijā, papildus prasības tiesvedības kārtībai un saistību bezstrīdus piespiedu izpildīšanai pastāv vēl viens veids – saistību piespiedu izpildīšana brīdinājuma kārtībā, kas nenoliedzami ir kļuvis par vadošo parādu piedziņas jomā. Saistību piespiedu izpildīšana brīdinājuma kārtībā orientēta uz to, lai parādniekam vēlreiz, bet nu jau ar tiesas starpniecību, atgādinātu par parāda esamību, tādejādi veicinot saistības labprātīgu izpildi.Darbā tiek apskatīts vispārējais saistību piespiedu izpildīšanas tiesiskais regulējums, veikta šī un citu tiesvedības veidu salīdzināšana, analizētas nepilnības Civilprocesa likuma 50.1 nodaļas normās, kuras regulē šo saistību piespiedu izpildīšanas tiesas ceļā veidu, kuru rezultātā veidojas nepareiza un problemātiska tiesu prakse, kas savukārt potenciālajos šī tiesiskā instrumenta izmantotājos vieš šaubas par procesa efektivitāti un lietderību. Darba autore apskata arī brīdinājuma kārtības problemātiku no praktiskā viedokļa, jo darba autore ikdienas darbā tieši saskaras ar šo problēmu risinājumu meklēšanu, kā arī iesaka savus priekšlikumus situācijas uzlabošanai. In the process of studying legislation and case law author arrives at a conclusion, that almost after six years of using the warning procedure as one of ways of performance of obligations through the court, most of the courts have a wrong or inconsequent practice of case reviewing in different aspects of warning procedure.
As a main aspect of wrong court practice author mentions the courts interpretation of meaning of the place of residence of the debtor and issuance of the warning to a debtor - there are a lot of situations, when a court decision is adverse to the interests of applicant (creditor) because of wrong interpretation of law. Often a court is trying to find out the literal meaning of certain paragraph, not the spirit of whole warning procedure.
Also author overview the lack of possibility to appeal the court decision about refusing to accept the application or decision about termination of the court proceedings for compulsory execution of obligations. Such problem incurs the situation, when the court mistake (they are possible and also are overviewed in this work) cannot be corrected and applicant must choose another way of performance of obligation – probably the most expensive and long-termed way of claiming.
