Parādsaistību pārņemšana iegādājoties dzīvokļa īpašumu

Abstract

Maģistra darba tēma „Parādsaistību pārņemšana iegādājoties dzīvokļa īpašumu” izvēlēta, ņemot vērā problēmsituāciju parādu atgūšanā, kas radušies dzīvokļa īpašniekam lietojot dzīvokļa īpašumu. Nereti dzīvokļa īpašnieks, atsavinot dzīvokļa īpašumu, izvairās no parādu nomaksas daudzdzīvokļu mājas pārvaldniekam un pakalpojumu sniedzējiem, šo pienākumu atstājot dzīvokļa ieguvēja ziņā. Latvijas likumdošanā nepieciešamas izmaiņas, kas paredzētu un precizētu atbildības pienākumu dzīvokļa īpašniekam atsavinot dzīvokļa īpašumu, kā arī paredzēt dzīvokļa īpašuma ieguvēja atbildību par parādsaistību pārņemšanu. Maģistra darbā tiek pētīts dzīvokļa īpašuma institūts un ar tā uzturēšanu saistītie izdevumi, parādsaistību rašanās cēloņsakarības, parādu piedziņas tiesiskie mehānismi, parādsaistību pārņemšanas tiesiskie elementi dzīvokļa īpašuma atsavināšanas rezultātā; kā arī tiek analizēti normatīvo aktu grozījumu projekti saskaņā ar vispārējiem tiesību principiem.

Master’s work theme „Debt commitment takeover purchasing apartment property” chosen considering problem situation in the recovery of the debt incurred by owner of the apartment using the residential property. Frequently, alienation the residential property, the owner of apartment avoids the payment of the debt to the apartment house manager and service provider this obligation leaving to the new apartment owner. Latvian legislation is necessary to have the changes that anticipate and clarify the responsibility of the owner of apartment alienation the residential property as well as to anticipate responsibility of the residential property obtainer about the debt commitment takeover. Master’s work explore the institute of residential property and its maintenance expenditure, debt commitment being causes, legal mechanisms of debt collection, legal elements of the debt commitment assumption in the result of apartment property expropriation.
