Vērtības jēdziens juridiskajā diskursā par nemateriālā kultūras mantojuma aizsardzību

Abstract

Maģistra darbs veltīts vērtības jēdziena analīzei tiesību diskursā par nemateriālo kultūras mantojumu. Sekojot pētījumā izvirzītajam mērķim atklāt vērtības kā tiesiska jēdziena nozīmes veidošanos un izvērtēt tā nozīmes noteikšanas teorētiskās iespējas un to pielietojuma sasniedzamos rezultātus, pētījums īstenots, izvirzot jaunu vērtības kā tiesību jēdziena lietojuma problemātiku. Pētījums analizē vēsturiski nesenu tiesību diskursu, kas ticis veidots XX gs. beigās un XXI gs. sākumā un saistāms ar UNESCO pieņemto Konvenciju par nemateriālā kultūras mantojuma saglabāšanu. Pētījums ietver dažādus teorētiskos skatījumus vērtības kā tiesību jēdziena analīzei - tiesību filosofiju, tiesību teoriju, kā arī tiesību semiotiku, kas sniedz atšķirīgus jēdziena nozīmes identificēšanas un interpretēšanas elementus. Teorētisko skatījumu dažādība un to piemērošana tiesību diskursa analīzē veido maģistra darba novitāti un nozīmi jēdzienu lietojuma problemātikas pētīšanā.

The master thesis defines a new problematic on the use of value as a legal term within the legal discourse on the intangible cultural heritage. The research analyses a historically recent legal discourse that has been developed at the end of 20th century and at the beginning of the 21st century, mainly represented by the Convention for the Safeguarding of Intangible Cultural Heritage adopted by the UNESCO. The research includes different theoretical perspectives for the analysis of value as a legal term - legal philosophy, legal theory and semiotics of law, where the analysis reflects various aspects on its identification and interpretation. The innovative contribution of the implemented research is within the combination between a reflection on the meaning of value that has to deal with philosophical perspectives, such as value relativism and value pluralism, its historical semantic transformations and a legal context where value is functioning within the legal discourse on the intangible cultural heritage.
