Doplomdarbā pētīts un analizēts labu tikumu kā ģenerālklauzulas pielitojums Civillikumā, to nozīme un loma tiesību piemērošanā, Civillikuma 1415. panta piemērošanas gadījumos.
Pētīta brīvās Latvijas tiesu prakse, mūsdienu tiesu prakse, kā arī atsevišķu ārvalstu piemēri.
Apstāklis, ka Civillikums nesniedz labu tikumu definīciju, tomēr nekavē tiesību piemērotājiem vadīties no tiem kā no tiesību principiem, kas izriet no dabiskajām tiesībām.
Šajos gadījumos īpaši nozīmīgu lomu iegūst tiesību piemērotāja prasme un spēja, veicot subsumciju, vadīties no likuma gara situācijās, kad likuma normu regulējums nav pietiekošs. Pastāvīgi atklāts tomēr paliek jautājums, kā tiesību piemērotājam šajos gadījumos palikt prasījuma ietvaros vai, ņemot vērā piemērojamos principus, padziļināti skatīt prasītāja pieminēto. The Diploma paper gives research and analysis of the clause of moral principles as a general legal principle, its role and importance in the interpretation of a legal action in case of application of Article 1415 of the Civil Law.
Court cases from the free Latvia, todays situation, several other countries are studied.
Although the Civil Law does not provide a definition of moral principles, it does not hinder the applicants of law to be lead by them as by one of the main legal principles that derives from natural law.
In those cases the ability of the applicant of law, while subsuming, to derive his reasoning out of the general principles of the law where there is no particular regulation, gains significant importance. However the issue remains open, to what extent an applicant of the law should remain strictly in the frames of the claim statement, or should he evaluate the principles mentioned in the claim in their wider scope.
