Darbā autore atklāj publisko un privāto tiesību mijiedarbību kodificētā civilprocesuālā regulējuma ieviešanas gaitā Latvijā un administratīvo tiesu izveidē. Norādītas vēsturiskas paralēles publisko un privāto tiesību mijiedarbības izvērtējumā Senāta tiesu praksē, kā arī sniegts šo izvērtējumu salīdzinājums.
Privāto un publisko tiesību mijiedarbība ir neatņema kodificētās tiesvedības procesa attīstības veicinātāja Latvijā jau apmēram 150 gadus.
Privāto un publisko tiesību mijiedarbība ir pakļauta cilvēktiesībām un citiem principiem, kas nepieļauj, ka valsts savu „pārākumu” pār indivīdu izmanto pēc saviem ieskatiem, patvaļīgi.
Neraugoties uz privāto un publisko tiesisko attiecību likumpakļautību, būtiskāk ir nodrošināt pieteicējam tiesības uz efektīvu tiesību aizsardzību un pieeju tiesai.
Privāto un publisko tiesību mijiedarbība procesuālo izpausmi gūst pakļautības un piekritības institūtā.
Darbā analizēta jaunākā publisko un privāto tiesību mijiedarbības praktiskā izpausme Senāta tiesu nolēmumos.
Autore darbā piedāvā vairākus likumu grozījumu projektus tiesvedības procesa pilnveidošanai. In the paper the author discusses the interchange of public and private rights while implementing the codified civil proceedings procedure in Latvia, and setting up administrative courts. Historical parallels have been drawn when evaluating the interchange of public and private rights in the practice of the Senate, as well as comparison of the evaluation given.
The interchange of private and public rights has been an integral facilitator of codified legal procedure development in Latvia for about 150 years.
The interchange of private and public rights is subject to human rights and other principles, that do not allow the state to use its „superiority” over the individual at its own discretion, arbitrarily.
Regardless of private and public judicial cognizance, what really matters isgranting the applicant the right to an effective protection of their rights, as well as access to court.
