Noziedzīgu nodarījumu kopība un tās ietekme uz kvalifikāciju

Abstract

Šī diplomdarba nosaukums ir „Noziedzīgu nodarījumu kopība un tās ietekme uz kvalifikāciju”, kas vienlaicīgi jau vairākus gadus, ir bijis strīdu objekts starp Latvijas tiesību zinātniekiem un tiesību piemērotājiem. Darbā ir uzsvērti būtiskākie momenti, kas jāņem vērā tiesību piemērotājam, lai varētu noteikt, vai noziedzīgs nodarījums ir izdarīts kopībā vai nē. Darba beigās ir kopsavilkums, kurā apkopoti galvenie secinājumi, kā arī priekšlikumi teorijas attīstībai un vienveidīgas prakses veidošanai, un tie būtu, ka teorijā īpaši ir jāakcentē, ka ideālās kopības gadījumā noziedzīgus nodarījumus var izdarīt gan ar vienu darbību, gan bezdarbību, otrkārt, reālo kopību varētu iedalīt vispārējā un speciālā kopībā, atkarībā no tā, vai ir konstatējamas Krimināllikumā noteiktās atkārtotības pazīmes.

The title of this diploma project is „The community of criminal offence and its influence on qualification” that has simultaneously been the object of an ongoing dispute between Latvian legal scientists and law enforcers. The project emphasises the most important elements of this dispute, which must be taken into account by law enforcers in order to determine whether a criminal offence has been carried out jointly or not. The project concludes with a summary in which the principal conclusions are collated along with proposals for the development of the theory and the establishment of a uniform practice, and these are as follows: in the event of an ideal community criminal offences may be committed both through a single action, as well as inaction, and secondly, the real community may be subdivided into an overall and a special community.
