Publisku personu tiesības uz privāto dzīvi

Abstract

Diplomdarbā tiek apskatīts un analizēts viens no cilvēka tiesību uz privāto dzīvi aspektiem – publisku personu tiesības uz privāto dzīvi. Darba autore ir izvirzījusi mērķi pētīt metodes, pēc kurām Eiropas Cilvēktiesību tiesa atrod līdzsvaru starp tiesībām uz privāto dzīvi un sabiedrības interesi, kura pavada publisku personu. Darbā autore analizē virkni problēmu: jautājumu par to, kā identificēt publisku personu; par to, kādas ir publisku personu privātās dzīves robežas; kā arī to, kādi ir noteikumi, pēc kuriem ir iespējams ierobežot publisku personu privātās dzīves robežas. Darbs ir sadalīts četrās nodaļās, kurās ir apskatītas augstākminētās problēmas un tiek piedāvāti risinājumi.

The diploma paper examines and analyses one aspect of the fundamental right to respect for private life – the right to respect for private life of public figures. The author has attempted to examine the methodology applied by the European Court of Human Rights in order to find the right balance between the right to respect for private life and the public interest in public figures. The author analyses a number of issues, in particular the question on how to identify public figures, how to determine the boundaries of the private live of public figures as well as what is the criteria which permit restrictions to the private live of public figures. The work is divided in four chapters, each of which deals with one of the above mentioned problems and offers solutions.
