Diplomdarba “Ētikas prasības Latvijas advokātu attieksmei pret tiesu” galvenās atziņas ir sekojošas.
Par advokāta attiecībām ar tiesu Latvijas Zvērinātu advokātu ētikas kodeksa regulējums ir pārāk īss un vispārējs. Latvijā kā postsociālisma valstī ētikas izpratne ir nepietiekama, vērtības nav tik stabilas, tādējādi ētikas prasības nevar būt īsas un vispārējas. Līdz ar to ir nepieciešams Latvijas Zvērinātu advokātu ētikas kodeksā ietvert plašāku un detalizētāku regulējumu, kā tas tika izdarīts daudzu citu postsociālisma valstu advokātu ētikas kodeksos. No ārvalstu advokātu ētikas kodeksos ietvertā regulējuma daudz kas var būt piemērojams arī Latvijas apstākļiem.
Advokātam ir jābalansē starp pienākumu sniegt tiesai patiesu informāciju un starp pienākumu drosmīgi aizstāvēt klienta intereses ar jebkuriem likumā pieļautiem līdzekļiem. Advokātam ir jārūpējas ne tikai par advokāta, advokatūras un sava klienta labo tēlu, bet arī par tiesas reputāciju, kas ir sevišķi svarīgi, ņemot vērā sabiedrības zemo uzticības reitingu attiecībā pret tiesām.
Tiesām būtu stingrāk jāizvērtē advokātu tiesas sēžu neapmeklēšanas iemeslus, lai mazinātu tiesas procesa novilcināšanas gadījumus. Advokāta Aināra Platača un advokāta Viktora Tihonova ētikas pārkāpumu lietas ir izraisījušas milzīgu rezonansi sabiedrībā, atklājot tās tumšās vietas tiesu varas sistēmā, par kurām līdz tam runāja tika paslepus, ka “dažreiz advokāts ir starpnieks starp klientu un tiesu kukuļa nodošanā, lai sasniegtu klientam vēlamo lietas iznākumu”. Pašiem advokātiem un sevišķi viņu priekšstāvjiem būtu jābūt visvairāk ieinteresētiem, lai attīrītu savas rindas no tādiem advokātiem, kas grauj advokāta profesijas reputāciju un visas tiesu sistēmas autoritāti. The principal conclusions of the diploma work “Demands of Ethics for Latvian Advokates` Attitude to Court” are the following.
As regards relations between advokates and court the regulations in The Latvian Sworn Advokates` Ethic Code are too concise and general. In Latvia, as a post-socialism country, ethic understanding is insufficient and values are not stable, therefore ethic demands should not be too concise and general. Thus it is necessary to include some wider and more detailed regulations in The Latvian Sworn Advokates` Code, as it was done in advokates` ethic codes of many other post-socialism countries. There are many things in foreign codes that could be adjusted to Latvian circumstances as well.
A lawyer must balance between his duty to present a true information to the court and the duty to be a courageous protector of his client`s interests with any legal means. A advokate must be concerned not only with the proper image of an advocate, the legal profession and his client, but also reputation of the court, the latter being especially significant with regard of the low trust rating for court in the society.
Courts should more carefully evaluate the reasons or motives of default at assizes in order to diminish cases of delaying court procedure. The ethic violation cases of advokate Ainars Platacis and advokate Victor Tihonov have tremendously resounded in our society, revealing those dark places in the legal system that were only secretly discussed up to then – that “advokate sometimes is a mediator between the client and court in bribery for a desirable result of the case”. The advokates themselves and their council in particular should be more interested to clear their rows from such kind of lawyers, which undermine the reputation of advokate`s profession and authority of the whole legal system.
