Šī pētījuma mērķis ir izskaidrot tiesnešu tiesību ievērošanas veidu. Izskaidrojumam ir izmantoti normatīvās un praktiskās filozofijas koncepcijas, kuras izstrādātas H.L.A.Hārta un Dž.Raza darbos un pilnveidotas citu juridiskā pozitīvisma zinātnieku pētījumos. Lai gan šīs idejas ir attīstītas anglosakšu tiesību loka valstīs, šajā darbā judikatūras doktrīna ir formulēta
kontinentālās Eiropas tiesību loka juridisko metožu izpratnē. Tāpēc tiesnešu tiesību dabas izskaidrojums ir piedāvāts mācības par tiesību normu ietvaros, īpaši izvērtējot judikatūras atziņu rašanos pilnveidotā juridiskā siloģisma subsumcijas) procesā un to funkcionēšanu tiesību sistēmā.
Darbā izstrādātā tiesnešu tiesību teorētiskā koncepcija ir paredzēta pielietošanai dažādās normatīvās sistēmās, lai identificētu tiesnešu tiesību īpašības Romiešu tiesībās un Jūdaismā. Pēc tam koncepcija pielietota Eiropas Cilvēktiesību Tiesas, Eiropas Savienības Tiesas, Satversmes tiesas un Latvijas tiesas precedentu doktrīnas izklāstam The purpose of this inquiry is to explain a manner of observation of judge-made law. Conceptions of normative and practical philosophy developed by H.L.A.Hart and J.Raz and consequently elaborated by other legal positivism philosophers are used for the explanation. Although theses ideas are elaborated in common law countries, precedent doctrine in this work is formulated within the understanding of legal methods common to Continental Europe. Therefore, a description of the nature of the judge-made law is provided within the theory of legal norm, particularly investigating creation of judicature's reason statements during a process of legal syllogism (subsumption) and their functioning in legal system.
The theoretical conception formulated in this work is applid to identify the nature of the judge-made law in the Roman law and Judaism, the European Court of Human Rights, the European Court of Justice, the Constitutional Court of the Republic of Latvia and the court of Latvia.
