Nekustamā īpašuma piespiedu atsavināšana sabiedrības vajadzībām

Abstract

Bakalaura darbā „Nekustamā īpašuma piespiedu atsavināšana sabiedrības vajadzībām” darba autors konstatē nekustamā īpašuma piespiedu atsavināšanas pieļaujamības pamatprincipus un, balstoties uz šiem pamatprincipiem, tiek meklēti risinājumi ar nekustamā īpašuma piespiedu atsavināšanas procesa norisi saistītajām problēmām. Galvenie problemātiskie jautājumi, kam autors darba gaitā pievēršas, ir lēnā nekustamā īpašuma piespiedu atsavināšanas procesa norise, atlīdzības apmēra noteikšana un tās izmaksas kārtība. Lai rastu risinājumus aktuālajām problēmām, autors izanalizējis nekustamā īpašuma piespiedu atsavināšanas institūta attīstību Latvijas Republikā no tās dibināšanas līdz pat mūsdienām, tāpat ņēmis vērā gan Satversmes tiesas, gan Eiropas Cilvēktiesību tiesas spriedumos paustās atziņas. Darba gaitā autors nonāk pie secinājuma, ka likumā „Par nekustamā īpašuma piespiedu atsavināšanu valsts vai sabiedriskajām vajadzībām” iestrādātie īpašuma piespiedu atsavināšanas pamatprincipi pilnībā nodrošina Satversmē ietverto indivīda tiesību aizsardzību, bet šis likums nenodrošina pienācīgu sabiedrības kopējo interešu ievērošanu. Lai risinātu šo jautājumu, darba autors aizstāv viedokli par nepieciešamību noteikt vienotus „taisnīgas atlīdzības” kritērijus, kuri būtu saistoši attiecīgajai institūcijai, vienojoties ar īpašnieku par izmaksājamās kompensācijas apmēru. Tāpat, piedāvā risinājumu, kā efektīvāk izvērtēt jautājumu, vai īpašuma piespiedu atsavināšana nepieciešama sabiedrības interesēs, kā arī pauž viedokli par atsevišķu likumos lietoto jēdzienu lietošanas pamatotību.

In the bachelor paper “Forced Expropriation of Real Property for Society Needs” the author states the basic principles of admissibility of the forced expropriation of real property and in accordance with these principles there are solutions posed to the problems concerning the process of the forced expropriation of the real property. The main issues that are discussed in the paper are – the slow process of the forced expropriation of real property and setting of the measure of reward and its payment procedure. To find the solutions for the topical problems the author of the paper has analysed the development of establishment of the forced expropriation of real property in the Republic of Latvia since its foundation until nowadays. The author also has considered the conclusions provided in sentences by the Constitutional Court and the European Court of Human Rights. During the research the author concluded that the basic principles of the forced expropriation of real property defined in the law “Law on Forced Expropriation of Real Property for State and Society Needs” completely guarantee the fundamental rights of the individual provided by the Constitution of the Republic of Latvia (Satversme). However, the law does not guarantee adequate observation of common interests of the society. To develop this topic the author maintains the opinion about the necessity to determine united criteria of “fair reward” that would be binding to the institution agreeing with the owner upon the measure of reward. The author also provides the solution for how to evaluate whether forced expropriation of real property is necessary for society needs. Moreover, author expresses the opinion on the validity of several notions used in laws.
