Darba mērķis ir noteikt, vai KPL 355. pantā ietvertā noziedzīgi iegūtas mantas prezumpcija nav pretrunā starptautiski un konstitucionāli garantētajām cilvēktiesībām- nevainīguma prezumpcijai un personas tiesībām uz īpašumu. Šajā nolūkā darba pirmajā nodaļā analizēta noziedzīgi iegūtas mantas institūta izpratne, ietverot arī paša jēdziena „manta” satura analīzi. Otrā nodaļa veltīta šīs legālās prezumpcijas mijiedarbības ar nevainīguma prezumpciju izpētei, izvērtējot atbilstību cilvēktiesību ierobežošanas pieļaujamības kritērijiem. Savukārt darba trešajā nodaļā atspoguļota šīs legālās prezumpcijas un personas tiesību uz īpašumu mijiedarbības tiesiskuma izvērtēšana.
Galvenās pašreizējā regulējumā konstatētās problēmas ir neprecizitāte, nenoteiktība un ļoti plašas jēdzienu formulējuma robežas, kā arī nepilnīga trešo labticīgo personu tiesību aizsardzība. The aim of the work is to ascertain compliance of the legal presumption of criminally acquired property with international and constitutional human rights- presumption of innocence and the rights to property. In the beginning the author analyzes the understanding of the concept of property in itself and the scope of the institution of criminally acquired property. The main issue- reciprocity of this legal presumption and presumption of innocence-is analyzed in the second section. The author concludes with appraisement of compliance of above mentioned legal presumption with the rights to property.
The main established problems and faults of current wording of this presumption are imprecision, uncertainty and overly broad scopes in formulating of corresponding legal norm and insufficient protection of the rights of bona fide persons.
