Valsts nodrošinātā juridiskā palīdzība Latvijā kā viens no tiesas pieejamības aspektiem

Tiesu pieejamība tiek uzskatīta par konstitucionālu tiesību, tas ir kā garants demokrātiskas iekārtas pastāvēšanai. Valsts, lai novērstu mantiskā stāvokļa esamību kā šķērsli pieeju tiesa, piedāvā bezmaksas juridisko palīdzību tiem, kam tā nepieciešama. Latvijā juridiskās palīdzības mehānisms ir vēl salīdzinoši jauns, jo tas tika ieviests tikai 2005.gadā. Tiesības uz juridisko palīdzību nav neierobežotas, un valstij nebūt nav jānodrošina ikvienam juridisko palīdzību savu interešu vai tiesību aizstāvībai. Likumdevējs nav piešķīris tiesības uz juridisko palīdzību ikvienam, bet ir noteikti vairāki kritēriji, kuriem izpildoties personai ir tiesības saņemt juridisko palīdzību, kā arī pastāv dažādi ierobežojumi. Pastāv vairāki juridiskās palīdzības atteikuma iemesli. Darbā tiek analizēts nepamatots juridiskās palīdzības pieteikums, saprātīga pieteicēja princips un nesavlaicīgs juridiskās palīdzības pieprasījums. Tiek apskatīts juridiskās palīdzības nodrošināšanas problemātika krimināllietās. Access to justice is a fundamental right, it is like a key for others rights. It is very important that person can defend her rights and interests in the court and the state has to insure that everybody has access to justice beause it is a part of democratic and legal state and society. Access to justice is very comprehensive and it includes a lot of other rights. It is important that rights we can find not only in acts but that they really exists in life. The reason that person has not enough money can not be restrictement to access to the justice. That’s why state ensure legal aid free of charge for those who need it, but can not afford, in this way promoting access to the justice. There are two aspects of the access to justice- institutional and processual. Rights to legal aid we include in processual aspect. In provision of it there is huge social and economical dimension influence.
Access to court and right to legal aid is not absolute and it can be restricted. When we talk about rights to legal aid then we realise that there are also rights to qualitative legal aid. But Legal aid adminstration of Latvia which duty is to manage the finances for legal aid can not it really effect it and depends of legal awarenesse of advocate.
Legal aid it is something new in legal system of Latvia and there are some things to overthink which are neceessary and would be progressive to change in the act of state legal aid provision – maybe implemente partial legal aid, allow to advocate extend provided legal aid, find the best solution of providing obligate defender in criminalprocess.
