Politiskais lēmums

Abstract

Darba mērķis ir iezīmēt politiskā lēmuma jēdziena būtību, noskaidrot politiskā lēmuma atšķirību no administratīva akta un pārējiem valsts pārvaldes lēmumiem, attiecīgā lēmuma pieņemšanas procedūru, tiesiskās aizsardzības mehānismu. Autore apšauba politiskā lēmuma absolūto nepiekritību tiesas kontrolei, norādot uz tā divējādo dabu – politisko (būtība) un juridisko (forma). Autore aizstāv tēzi par to, ka politisko lietderību tiesa nevar izlemt, respektējot varas dalīšanas principu, bet politiskā lēmuma, kas ir vērsts uz individuālu personu konkrētā gadījumā, juridiskajām ietērpam (procesuālajām tiesiskumam) jābūt pakļautam kontrolei.

The aim of the paper is to broadly describe the concept of political decision, differentiating that from administrative act and other decisions carried out by state institutions, procedure of adoption and individuals’ rights protection mechanisms. Author questions the exemption of political decision from the judicial control on the grounds of complex nature of the notion, being political in nature, but judicial in form. Author argues that court, in full accordance with the principle of division of powers, should not question the essence of the decision, but for political decisions aimed at certain private individual in particular case the rule of law in procedures should be enforced indeed.
