Darba aizsardzības noteikumu pārkāpšana

Abstract

Šajā darbā autore pēta Latvijas Republikas likumisko regulējumu tāda noziedzīgā nodarījuma kā darba aizsardzības noteikumu pārkāpšana. Šis noziedzīgais nodarījums ir nozīmīgs tāpēc, ka aizskar personas pamattiesības un pamatbrīvības, un proti, tiesības uz drošu, veselībai un dzīvībai nekaitīgu darba vidi, kā arī tiesības uz dzīvību un veselību. Autore analizē šās likuma normas attīstību vēstures gaitā, pētot un salīdzinot tiesību avotus, kas bija spēkā Latvijas teritorijā no 20. gadsimta sākuma un līdz mūsdienām. Kā arī autore analizē tiesību uz drošu, veselībai un dzīvībai nekaitīgu darba vidi normatīvo regulējumu starptautiskajā līmenī, pētot nozīmīgākos starptautiskos tiesību aktus, un pievēršot uzmanību nozīmīgāku organizāciju darbībai šajā jomā. Autore arī analizē nacionālos tiesību aktus, kur nostiprinātas tiesības uz drošu, dzīvībai un veselībai nekaitīgu darba vidi, un noskaidro to atbilstību starptautiskajām regulējumam. Darbā detalizēti tiek analizēts noziedzīgā nodarījuma sastāvs, kā arī analizēta Latvijas Republikas dažādu instanču tiesu prakse šajā jautājumā. Autore analizē un salīdzina darba aizsardzības noteikumu pārkāpšanas tiesisko regulējumu tādās valstīs kā Lietuva, Igaunija, Spānija, Austrija, Norvēģija, Zviedrija, Beļģija, Šveice, Vācija, Krievija, Armēnija, Polija un Francija. Šajā darbā autore izsaka savu viedokli par problemātiskajiem jautājumiem, kas saistīti ar pētāmo noziedzīgo nodarījumu, proti, ar to subjekta noteikšanu un nodarījumam atbilstošā soda noteikšanu, kā arī autore izsaka savus priekšlikumus par šā noziedzīgā nodarījuma kvalifikācijas un tiesiskā regulējuma pilnveidošanu.

The author of this thesis inquires into the legislative control of such an illegal act as the violation of the labour protection regulations. This illegal act is substantial, because it concerns person’s main rights and freedoms, that is, rights to have a safe, healthy workspace, as well as rights to live and be healthy. The author analyses the development of this norm of law in the course of history, investigates and compares the sources of law that existed in Latvia from the beginning of the 20th century until nowadays. The author also analyses the right to have a safe workspace, harmless for health and life, at the international level of normative regulation, investigates the most significant international legal statements and draws attention to activities of the most important organizations in this sphere. The author also analyses national legal statements, where the rights to have a safe workspace, harmless for health and life are consolidated, and finds out the correspondence of those with the international regulation. The essence of the illegal act is analyzed in a detailed way in this thesis, as well as judicial practice in this aspect of different degrees of jurisdiction of the Republic of Latvia. The author analyses and compares the legal regulation of violation of the labour protection regulations in the following countries: Lithuania, Estonia, Spain, Austria, Norway, Sweden, Belgium, Switzerland, Germany, Russia, Armenia, Poland and France. The author of this thesis expresses her opinion on the problematic issues connected with the considered illegal act, that is, with definition of its subject and adequate punishment. The author also makes suggestions on the improvement in qualifying this illegal act and its legal regulation.
