In the bachelor’s assignment „Indispensable defence during pre-trial criminal procedure” the author has examined the definition of mandatory defence and the changes that have been made due to establishing The Criminal Procedure Act, proposing formulation that would be appropriate for the instant regulation. Particular attention has been paid to the examination and the analyses of the cases when defence counsel has been set as mandatory, comparing them to the ones that were set in prior codes and are established in foreign acts. Conclusions are drawn upon the justification of appointing mandatory defence and suggestions are hold out to define more accurately and precisely the uncertain statements. Also the emergence and the cessation of the imposed defence has been inspected, and the importance of the advocates participation in the pre-trial process evaluated.
