Maģistra darbā analizēti nodokļu maksātāju tiesību un tiesisko interešu aizsardzības mehānismi administratīvajā procesā. Pētījumā secināts, ka iedzīvotāju ienākuma nodokļa maksātājiem noteiktie procesuālie ierobežojumi pārkāpj tiesības uz taisnīgu tiesu.
Pētījumā secināts, ka nodokļu likumos noteiktais nodokļu maksātāja pienākums sadarboties ar nodokļu administrāciju pārkāpj Eiropas Cilvēktiesību un pamatbrīvību konvencijas 6.pantā paredzētās tiesības neapsūdzēt pašam sevi.
Pētījumā atzīts, ka nepieciešams precizēt nodokļu sodu piemērošanas pamatus, kā arī secināts, ka nodokļu maksātāji bez objektīva attaisnojuma pakļauti atšķirīgai attieksmei. The paper analyses protective mechanisms of the tax payer’s rights and legal interests in administrative proceedings. The author concludes that procedural restrictions concerning presenting of evidence for income tax payers violate the right to fair trial.
The author concludes that a fine imposed on the tax payer for refusal to provide information is an improper measure of compulsion and breaks the right not to incriminate oneself provided in Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
The author establishes that more precise grounds of tax surcharge application must be defined and that the tax payers are subjected to different tax surcharges and such a difference of treatment has no objective and reasonable justification.
