Ar brīvības atņemšanu vai mantiska rakstura piedziņu nesaistītu soda sankciju pārrobežu izpilde

Abstract

Diplomdarbā tiek apskatītas problēmas, kas saistītas ar tādu tiesisku sankciju pārrobežu realizāciju, kuras nav saistītas ar brīvības atņemšanu un mantiska rakstura piedziņu. Pamatojoties uz Latvijas pieredzi un pieejamo informāciju par šādu sankciju piemērošanas daudzumu pasaulē tiek konstatēts, ka sankcijas tiek piemērotas bieži, bet pārrobežu izpildes mehānismi funkcionē vāji. Tādējādi, tiek pierādīta šo problēmu aktualitāte un nepieciešamība tās risināt. Tiek apskatīti sankciju veidi, to izpildes īpatnības, kā arī pārrobežu regulējuma izveides vēsture, tiek attēloti pastāvošie regulējuma modeļi un dota to kritika. Par pamatu risinājuma meklējumiem tiek ņemta atziņa, ka problēma ir risināma kompleksi un tās risinājums jābalsta dabisko tiesību skolas atziņās, pārņemot labāko no tiesību pozitīvisma. Pastāvošā diskusija par problēmas piederību kādai tiesību nozarei tiek atzīta par tīri sholastisku un tādu, kas nedrīkst atstāt iespaidu uz problēmas praktisko risinājumu. Tiek prognozēts, ka praktiskais risinājums varētu tikt sasniegts caur Eiropas Savienības tiesību aktu pieņemšanu, ja tie tiks pieņemti savlaicīgi un ievērojot virkni noteikumu, kuri tiek uzskaitīti darbā. Ievērojot, to, ka Latvijai ir pieredze darbā ar tiesību aktiem, kas līdzinās tiem, ar kādiem ES patlaban mēģina risināt problēmu, proti, ar vispārīgiem likumdošanas pamatiem, tiek proponēta doma, ka Latvija var sniegt nozīmīgu ieguldījumu šajā procesā.

Aim of Graduation work is concentred on problems of cross border execution of non custodial and non monetary legal sanctions. Within the frame of work reviewed schedule of these sanctions, their contents, evolution of cross border executions system. Author reviewed existing models of regulation and making analysis of them. Also, discussion on matters which delay dissolving of problems, such as “the right form” and “right branch affiliation” is reviewed. These discussions clear intratheoretically character, as discussion between school of natural and school of positive law, for dominating role, is demonstrated. These discussions might not make any influence on practical dissolving of problem. On Example of situation in Latvia shows necessity and urgency of dissolving. Noted that Latvia as former union republic of Union of Soviet Socialist Republics has very important for European Union expierence of applying legal acts of type “unified legislation principles of Union of SSR and unified republics”, which in reality are similar to framework decisions of Council of European Union. Latvia has experience at working in corresponding legal regime, too. Problems with cross border regulation for non custodial and non monetary sanctions could be dissolved. For that is necessary to establish new body what will include all necessary elements. In process of establishing is possible to based on system what could be establish on documents like Framework decisions (unified legislation principles). For illustrating possibilities in frame of work author use situation in European Union, however, model is suitable for anybody. In according of present situation in the World, model if it will be accepted by European Union could be base for practical dissolving of problem on whole world. Each community establishes sanctions what is possible to use against offender of their rules, and at the present we try to found a way for using any of human sanctions all over the World.
