Šī darba tēma ir „Paternitātes noteikšana un apstrīdēšana”, kura mērķis ir ne tikai aplūkot paternitātes noteikšanas institūtu kā tādu, bet arī apzināt kādas ir aktuālākas problēmas tiesu praksē, kāds ir šo problēmu regulējums un atrisinājums ārvalstīs. Īpaši autore pievērš uzmanību to personu lokam un viņu tiesībām apstrīdēt paternitāti, kuras nav likumā uzskaitītas pie personām, kurām ir atļauts apstrīdēt paternitāti. Secīgi tiek aplūkoti arī nepieciešamie pierādījumi, kas jāiesniedz tiesā šādās lietās. Autore secina, ka trešajām personām nav tiesību apstrīdēt paternitāti, kura ir jau labprātīgi atzīta no cita vīrieša puses. Jo citām personām nav tiesību iejaukties jau juridiski nostiprinātā ģimenē. The theme of this paper is “The Determination and Disputing of Paternity” and aim of it is not only to examine institution of paternity as it self, but also study what are the most common problems in job of the court, what is controllable and solution for these problems in foreign countries. Especially author pays her attention to persons which are not affected by the law to dispute paternity. Also author in her paper deals with problem what kinds of evidences are good enough in these cases to prove paternity. One of the main conclusions which author has came to is that no person can’t dispute paternity when it’s already admitted of one’s man free will. Because other persons have no rights no interfere in family in which child gets all his love and support.
