Lisabonas līgumā ietverto reformu ietekme uz lēmumu pieņemšanas procesu Eiropas Savienības tieslietu jomā

Lai Eiropas Savienībā turpmāk efektīvi varētu tikt sasniegti dalībvalstu izvirzītie un pamatlīgumos nostiprinātie mērķi, ir nepieciešamas būtiskas izmaiņas līdzšinējā institucionālajā ietvarā un to darbības mehānismā. Sekojot tendencēm pasaulē, brīvības, drošības un tiesiskuma joma ir kļuvusi par vienu no nozīmīgākajām, tādēļ, lai nodrošinātu tās efektīvu darbību, ir nepieciešamas nozīmīgas izmaiņas.
Šobrīd ratifikācijas procesā dalībvalstīs ir Lisabonas līgums, kas Eiropas Savienībai sniegs tādu tiesisko regulējumu un instrumentus, lai rastu atbildes uz turpmākajiem izaicinājumiem un iedzīvotāju prasībām, veicinot reformas, tajā pašā laikā saglabājot izveidotā institucionālā līdzsvara spēcīgos pamatus, kas pēdējo piecdesmit gadu laikā ir ļāvuši ES sekmīgi funkcionēt.
Ņemot vērā Lisabonas līguma aktualitāti, kā arī vēlēšanos dziļāk izprast tā ietekmi uz tieslietu jomas darbību, šis jautājums ir izvēlēts par maģistra darba tēmu.
Darbā ilustrēta šobrīd vēl aktuālā ES trešā pīlāra darbības joma, tās vēsturiskā attīstība, pīlāra kompetences norobežošanas problemātika, kā arī detalizēti tiek atspoguļota šī brīža lēmumu pieņemšanas kārtība. Darbā konstatēti tieslietu jomas efektīvas darbības šķēršļi, kā arī analizēti iespējamie risinājumi. Darba pētnieciskā daļa veltīta Lisabonas līgumā paredzēto būtiskāko izmaiņu analīzei, to ietekmei uz tieslietu jomu, plānotās lēmumpieņemšanas procedūras izpētei, kā arī šo faktoru ietekmei uz Latvijas tiesību sistēmu. In order to efficiently achieve the goals set by the Member States and established in the basic treaties in the future in the European Union, essential changes must be made within the present institutional framework and their operation mechanism. Following the trends in the world, the area of freedom, security and justice has become one of the most significant issues, and in order to ensure its efficient activity there are essential changes required.
At present the process of ratification by the Member States is undergoing the Treaty of Lisbon, which will ensure the European Union with such legal order and instruments allowing to find answers to further challenges and requirements of the citizens, facilitating reforms, at the same time maintaining the strong basis of the established institutional balance that has enabled successful functioning of the EU during the last fifty years.
Having regard of the topicality of the Treaty of Lisbon, as well as the willingness to extend the understanding of its effect on the activity of the area of justice, this issue has been chosen as the subject of the Master’s Paper.
The Paper reveals the activity scope of the currently still topical third pillar of the EU, its historical development, the problems of the pillar jurisdiction delimitation, as well as reflects in details the current decision-making process procedure. In the Paper there have been found obstacles to efficient activity of the area of justice, as well as analysed the possible solutions. The research part of the Paper is devoted to analysis of the most essential changes envisaged in the Treaty of Lisbon and their effect on the area of justice, research of the planned decision-making procedure, as well as to the impact of these factors on the legal system of Latvia.
