Bakalaura darba tēma ir „Probācijas nozīme soda noteikšanā un izpildē”. Tēmas ietvaros tiek apskatīti svarīgākie jautājumi, kas skar sekmīgu probācijas ieviešanu un probācijas funkciju efektīvu realizēšanu Latvijas Republikas teritorijā.
Bakalaura darba tēmas izvēle ir saistīta ar to, ka arvien lielāku popularitāti Eiropā gūst ar brīvības atņemšanu nesaistītie sodi, bet Latvijā ilgi valdīja situācija, kas liecināja par to, ka visplašāk piemērojamais sods ir brīvības atņemšana. Pēc atbrīvošanās no brīvības atņemšanas soda izciešanas, personām netiek sniegta palīdzība un veikta to uzraudzība nepieciešamā apjomā, kas ir viens no noziedzīga nodarījuma cēloņiem. Tādējādi, lai valstī tiktu garantēta drošība un nodrošināta sabiedrības labklājība, ir jāveic izmaiņas noziedzīga nodarījuma izdarītāja personībā un domāšanā, dodot pozitīvu virzību, integrējot noziedznieku sabiedrībā.
Darba mērķis ir noskaidrot probācijas nozīmi pirmstiesas kriminālprocesā un iztiesāšanas stadijās nosakot sodu, kā arī sodu izpildē, noteikt problēmas un iespējamos risinājuma veidus.
Pēdējos gadu desmitos noziedzība ir kļuvusi par masveida sociālu parādību, un ir acīmredzams, ka tradicionālās metodes tās apkarošanai kļūst neefektīvas, neveicina likumpārkāpēju labošanos un reintegrāciju sabiedrībā, tāpēc jāmeklē jaunas iespējas sociālā taisnīguma atjaunošanai, kas ir viens no noziedzības apkarošanas pamatprincipiem.
Valsts probācijas dienests ir institūcija, kas ir loģisks noslēgums ne tikai brīvības atņemšanas soda izciešanas procesam, bet turpina to darbu, ko bija sākusi policija, konstatējot noziedzīga nodarījuma pastrādāšanas faktu.
Valsts probācijas dienesta mērķis ir pēc iespējas vairāk atslogot kriminālās justīcijas sistēmu, veicinot alternatīvu ieviešanu brīvības atņemšanas sodam un citu sankciju piemērošana, kas balstās uz likumpārkāpēju stingru uzraudzību un kontroli.
Bakalaura darbs sastāv no vairākām nodaļām kā, piemēram, probācijas jēdziena un vēsturiskā attīstība, probācijas nozīme soda izpildē, probācijas tiesiskā reglamentācija un finansējums pasaulē salīdzinājumā ar Latvijas Republiku.
Darba gaitā autore izvirza secinājumus un sniedz priekšlikumus Tieslietu ministrijai, un Valsts probācijas dienestam, kā arī analizē Latvijas normatīvos aktus salīdzinājumā ar citām pasaules valstīm, papildus atspoguļojot statistikas datus tabulās un shēmās. The theme of the bachelor paper is the meaning of the Probation in Punishment Deterimination and Execution. The most profound issues related to successful probation administration and function realization in the Republic of Latvia have been reviewed.
The choice of the present paper has been made in connection with the fact that nowadays most frequently punishment which is unrelated to deprivation of freedom gain popularity in Europe. On the contrast in Latvia the deprivation of freedom is the leading solution. Therefore, in order to guarantee potectability and social welfare, the changes in criminal’s mind has to be made thus integrating him into society.
The purpose of the paper is to ascertain the meaning of the probation before trial of the criminal process as well as the meaning of it during the trial period, punishment making, to state the problems and possible ways to its resolvement.
During the last decades criminality has become a broad social phenomena and it becomes obvious that the methods of the fight against criminality have become ineffective, they do not lead to criminals’ improvement and reintegration into society. That is why new possiblities to renew the social justice have to be found since it is one of the basic principles in the fight against criminality.
State probation service is the institution which is considered to be not only the logical end of the process of deprivation of freedom but continues its performance which has been started by the police when facting the crime.
The State Probation Service is created in order to facilitate the prevention of crime in the state, in order to provide for the qualitative performance and coordination of the publicly served sentences and to relieve the work of the other justice protection organisations.
The bachelor paper consists of such chapters as the meaning and historical development of probation, its role in punishment execution, its judicial reglamentation and financing in the world in comparison with the Republic of Latvia.
During the research the author makes conclusions and gives suggestions to Ministry of Justice and State probation service as well as analyze Latvia’s normative acts in comparison with other world countries, in addition some statistical data is shown in tables and schemes.
