Šī darba tēma ir ‘Autora tiesība atsaukt savu darbu’. Autortiesības ir intelektuālā īpašuma paveids. Autora tiesība atsaukt savu darbu ir viena no viņa personiskajām jeb nemantiskajām tiesībām.
Līdz šim nav bijušas plašas diskusijas par šo tēmu.
Pastāv viedoklis, ka šī autora tiesība ir visai simboliska, jo tā ir samērā reti izmantota, tomēr tā tiek uztverta kā ļoti nozīmīga, jo autora personība visā pasaulē tiek augstu vērtēta. Ir divas lielas tiesību sistēmas – kontinentālās Eiropas un Angļu – amerikāņu. Katrai ir savs atšķirīgs redzējums.
Ar šo darbu autore cenšas parādīt, ka ir nepieciešams pievērst uzmanību atšķirībām, kādas valda Autortiesību likumos atsevišķās kontinentālās Eiropas valstīs. Ir valstis, kuras atzīst, ka autoram ir personiska tiesība atsaukt savu darbu, taču ir arī tādas, kuras min būtisku niansi. Tā nosaka, ka autors savu darbu var atsaukt vienīgi pamatojoties uz savas pārliecības maiņu.
Šī darba mērķis ir parādīt, ka Latvijas Autortiesību likums sniedz autora personisko tiesību uzskaitījumu, tajā skaitā arī autora tiesību atsaukt darbu, kamēr, piemēram, Itālijas Autortiesību likums nosaka, ka autors var atsaukt savu darbu, ja viņam mainījusies pārliecība.
Šim viedoklim varētu būt oponenti, kuri izrādītu šaubas, vai Latvijas Autortiesību likumā minētie grozījumi būtu veicami. Šī darba autore uzskata, ka grozījumi ir nepieciešami, jo ir būtiski, lai likumi būtu saprotami un interpretējami atbilstoši situācijai, kurā rastos tā normas pielietot. The theme of research work is ‘Author’s right to revoke his work’. Author’s
rihgts are included in Copyright, that is one of fields under intellectual property. That is
copyright or, in other words, one of author’s moral rights, the right to withdraw his work.
There has not been much discussion about this author’s right, because of it’s rare
use.
It’s stressed, that this right is quite symbolic one though very important, because
of author’s personality recognized world wide. The only big difference is that there are
two big legal systems – Continental Europe an Anglo – american - with quite different
views.
By writing this work author tries to show, that it is necessary to draw attention to
differences in Copyright acts in some of Continental Europe countries. In other words,
there are countries that only recognize author’s moral right to withdraw his work, and
others, that sets down the important nuanse, that author can withdraw his work only
because of his serious moral reasons.
The aim of this research is to show, that Copyright act of Latvia only enumerate
author’s moral rights, while, for example, in Italy it is said that author can use his right of
withdrawal only if he has serious changes in his conviction.
The question of opponents could be, is it really necessary to do this addition in
Copyright act of Latvia. Author’s answer is, yes, it is necessary, because it’s quite
important to make laws comprehensible and in the same time not too narrow or large for
it’s interpretation when there is a need for utilization in practice.
